RESOLUTION 83-3063 ~ CITY OF HOPKINS Hennepin County, Minnesota " RESOLUTION NO. 83-3063 ADOPTING A HOUSING PLAN INCLUDING A PROGRAM FOR THE ISSUANCE OF MULTIFAMILY MORTGAGE REVENUE BONDS AND AUTHORIZING SUBMISSION OF SAME TO THE METROPOLITAN COUNCIL AND THE MINNESOTA HOUSING FINANCE AGENCY. WHEREAS, pursuant to the Minnesota Municipal Housing Act, Minnesota Statutes, Chapter 462C (the "Act"), a City is authorized to adopt a housing plan and carry out programs for the financing of multifamily housing for persons of low and moderate income; and WHEREAS, the Act required adoption of the housing plan after a public hearing held thereon after publication of notice in a newspaper of general circulation in the City at least thirty days in advance of the hearing; and WHEREAS, the City of Hopkins (the "City") has on this date conducted a public hearing on a housing plan (the "Housing Plan"), after publication of notice as required by the Act; and ). WHEREAS, the Housing Plan includes a program (the "Program") for the issuance of multifamily housing revenue bonds to finance two housing developments known as Wests ide II and Auburn North and South; and WHEREAS, The Act further requires submission of the Housing Plan to the Metropolitan Council for its review and comment, and submission of the Program to the Minnesota Housing Finance Agency (the "MHFA") for its approval; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hopkins: adopted. 1. That the Housing Plan of the City, including the Program, is hereby 2. That three separate bonds be issued; one for Westside II; one for Auburn North; and one for Auburn South. ^ 3. That the City manager is hereby authorized to submit the Housing Plan to the MetropDlitan Council, and to submit the Program to the MHFA, and to do all other things and take all other actions as may be necessary or appropriate to carry out the Program in accordance with the Act and any other applicable laws and regulations. Certificate of Public Conveni nce and Nec ssit No person shall operate or i;errl.1. t a t,n..":i.cab owned or con rolled by 0 oper- ated as a vehic]e for hire upon the streets of the City of Hopkins without having first obtained a certificate of public convenience and necessity fram the City Council. Section 475:06. Application for Certificate. An application for a certificate shall be filed with the City Clerk upon foms provided by the City of Hopkins and said application shall be verified under oath and shall furnish at least the following information: The name and address of the applicant, his financial status, inclUding the amounts of all unpaid judgments against the applicant and the name of the transaction or acts giving rise to said judgments; The experience of the applicant in the transportation of passengers; The number of applicant's driver's license and chauffeur's license, as well as such numbers of arry and all employees intended by said applicant to be used to be employed as taxicab drivers; The number of vehicles to be operated or controlled by the applicant; A The color scheme or insignia to be used to designate the vehicle or vehicles of the applicant; Such further information as the City of Hopkins may from time to time require; Each such applicant shall further state on such application any facts or other evidence which the applicant believes tend to prove that public convenience and necessity require the granting of such certificate. Section 475 :09. Public Hearing. Upon the filing of an application for such certi- ficate, the City Council shall fix a time and place for a public hearing thereon. Notice of such .hearing shall be gi. ven to the applicant and to all persons to whom certificates of public convenience and necessity have heretofore been issued and r main valid. Due notice shall also be given the general public by posting a notice of such hearing in the City Hall of the City of Hopkins. The City Council may in addition to the above, cause one (1) publication of such notice in the official newspaper of the City, such publication to be not less than (5) days prior to the date thereof of such hearing. Any interested persons may file with the City Clerk a memorandum in support of or opposition to the issuance of a cert- ificate. Section 475:12. Issuance of Certificate. If the City Council finds that taxicab service or further taxicab service in the City of Hopkins is required by the public convenience and necessity and that the applicant is fit, willing and able to per- form such public transportation and to conform to the provisions of this Ordinance, and any repulations or rules promulgated thereunder by the City Manager, then the City Clerk shall issue a certificate of convenience stating the name and address of the applicant, the number of vehicles authorized, and the date of issuance; otherwise the application shall be denied. In making the above findings, the City Council shall take into consideration the number of taxicabs already in operation, whether existing transportation is ade- quate to meet the public need, the probable effect of increased service on local traffic conditions and upon such taxicab service, and the character, experience
