ORDINANCE NO. 83-522
AN ORDINANCE REQUIRING FENCING OF ALL OPEN
OUTDOOR STORAGE YARDS AND OTHER RELATED
ATTRACTIVE NUISANCES IN COMMERCIAL AND
INDUSTRIAL AREAS.
BE IT ORDAINED by the City Council of the City of Hopkins as follows:
SECTION 1 - DEFINITION: Open Outdoor Storage Yards are hereby defined as
any premises in Hopkins located in any areas zoned for industrial or commercial
purposes which are or may be used for the temporary or permanent storage of any
moveable goods, wares or merchandise, which premises are open and/or accessible to
the public as attractive or other related nuisances.
SECTION 2 - FENCING REQUIRED: Any and all open outdoor storage yards or
areas located and used on premises zoned for commercial or industrial purposes shall
be and remain enclosed by a durable, permanent fence which shall be of dense, sturdy
materials and be not less than six feet in height and maintained as may be needed
or required to prevent any unauthorized entrance into or on such premises.
SECTION 3 - PROHIBITED STORAGE: Any and all open outdoor storage
of any commercial or industrial materials in any unfenced area as above described
is hereby prohibited except the temporary storage of materials needed and being
used for on-going, active building construction on such premises.
SECTION 4 - PENALTIES: Any owner, person, firm or corporation who
violates any of the terms or provisions of this Ordinance or who fails to comply
with any report or order issued by the Hopkins Building Inspector as to storage
shall be guilty of a petty misdemeanor. Each day that the owner or other operator
fails to comply with any such report or Order of this Ordinance shall constitute
a separate offense and such separate offenses may be alleged in one pleading or
complaint and heard or tried at one hearing or trial, with separate penalties
resulting or issued therefrom.
SECTION 5 - EFFECTIVE DATE: This Ordinance shall take effect and be
in force on and after September 1, 1983.
First read at a regular meeting of the City Councll of the City of
Hopkins held April 19, 1983, and finally read, approved, adopted and ordered
published at a regular meeting of said Council of said City on May 3, 1983.
