STAFF FINDINGS & COMMENTS: Norris - Kerrigan
1. Applicant is proposing to construct a 17.5' x 50' addition to the west end
of existing structure (110'x50'). Proposed addition is to be located on a
portion of the lot that is presently gravel. Addition is to be occupied
by an existing liquor store moving from another site in Hopkins.
2. Existing structure encroaches on side yard by 5 feet (a variance was issued
for this in 1979). Applicant wishes to have addition conform to the existing
structure. Ordinance 427.35 requires that any structure in a B-3 district
with a side yard abutting a residential district have a minimum side yard of
15'. Applicant is proposing a side yard of 10 feet and is requesting a vari-
ance of 5 feet. Ordinance 427.35 requires that any structure in a B-3 district
abutting a residential district have a minimum front yard of 15'. Applicant
is requesting a variance and is proposing a yard of 1'. Subject property is
abuttlng an R-5 district to the south. along the side yard, and abutts a B-2
district across the street from the front yard.
3. Ordinance 427.23(3) states that variances shall be issued in cases where strict
enforcement of the ordinance causes undue hardship to the owner due to unique
characteristics of the subject property. Applicant has stated that the variance
is requested so the proposed addition will conform to the existing building,
and also that a similar variance was granted in 1979 for construction of the
original building.
4. Sufficient parking is provided for the additional parking requirements for the
proposed addition.
5. In 1979 the Zoning and Planning Commission and Council approved an application
by the present applicant for a multiple use building on this site.

STAFF COMMENTS: - Norris
At the April Zoning and Planning meeting, the Commission requested information from
the original site plan for the structure at 5 - 6th Avenue South. The original site
plan shows a shrubs and grass area to be directly west of the building. A grass
area is also shown to be west of the parking directly north of the building. The plan
shows a dumpster drea to be screened (no details are given) along the back of the
building, near the southeast corner.
Presently, the area to the west of the building (where proposed addition is to be
located) is gravel. The area to be grass on the original site plan is planted with
various flowers. The dumpster is located along the back of the building approximately
10-151 from the southeast corner. The west side of the dumpster is bounded by a trnas-
fonmer. The east side of the dumpster is screened by a wood fence. Ordinance 427.37
states that trash containers are permitted accessony uses in aBdistrict, provided they
are screened.

The Commission also inqui~ed about any police reports regardlng the parking lot.
Commander Pratt stated that there were no formal complaints about the lot and that
he was not aware of any problems occurring there.
When the applicant appeared beforetteCommission in 1979, the Commision determined that
the front yard of the property was along 6th Avenue South, and that it did abut a
residential district to the south.
