BULDING ADDITION . . . COMMENTS ON IMPACTS OF PRESENT BUILDING AND PROPOSED ADDITION TO BUILDING AT 5 - 6th Avenue South At the April 26, 1983 meeting of the Zoning and Planning Commission a proposal was presented to build a 17.5'x50' addition on the west side of the existing building for use as a liquor store. The original building permit was issued in 1979 with a landscaped front yard of 18.5 feet and a side yard of 10 feet on the south side abutting a public alley. A dumpster was to be located at the southeast corner of the building. At the April 26th meeting questions were raised as to the effect on the public alley of present and future use such as parking of trucks for unloading store mer- chandise, the parking of cars in the 10 foot sideyard and the location and screen- ing of the existing dumpster and landscaping. The Commission continued the hearing to have the City Engineer prepare a report on these concerns. A. Landscaping in Front Yard The developer stated that it was difficult to maintain landscaping due to vandal- ism. The plan proposed would leave 1 foot between the building and property line which is too narrow for significant landscaping. However, the developer indicated he would have the curb and gutter and sidewalk replaced. Therefore it would be possible to create a 4' grassed boulevard on which trees could be planted as a landscaping amenity. B. Parking Problems Along Alley There is space for 4 cars to park parallel to the alley south of the building in the 10 foot sideyard. These cars are parked west of an electrical transformer and a refuse dumpster. It would be possible to park one additional car east of the dumpster. None of these uses in the sideyard interfere with the use of the alley for traffic. The location of the dumpster is somewhat west of the location shown on the plan approved tn 1979. It is also partially screened by a wood fence. This location is probably better from the standpoint of alley traffic northbound and turning left to go west, as this location gives a wider turning area (if it is not occupied by a parked car). C. Alley Use By Delivery Trucks Obviously it takes many varieties of trucks to bring the products sold in a grocery store. Some come every day, others at widely varying times. These must be parked for varying periods of time to load and unload. If the alley is used frequently, it could cause some inconveniences to thru traffic. However, the in- stances observed of this type of blockage are infrequent. Most of the deliveries are by trucks parking on the street, parking lot or driveway to the west access door. If a truck is blocking the alley, a car northbound can go around the east side of the store and exit through the store parking lot to 6th Avenue or it could go east through the Dow Towers lot and exit on 5th Avenue. For a southbound vehicle desiring to turn left into the alley behind the store it could use the driveway thru the front of the store to gain access to the N-S alley. In actuality, the private drives are probably used by residents of Dow Towers and the homes to the south of the store as often as the alley. . . - 2 - Enclosed is a copy of the City Ordinances which govern alley use. In this case, the property does have access other than the alley. Consequently, the right to block the alley for the period stated (one hour) would not prevail. The addition of the liquor store would eliminate the service door on the west side. Therefore deliveries would be mainly from the front of the building from the parking lot. If necessary, a truck loading zone could be established on the east side of 6th Avenue from the alley northward to the main driveway. This could be limited to the morning hours. Otherwise this section is posted for One Hour Parking. D. Drainage Pipes Affecting Possible Building Expansion to the East and North. The grocery site, Weckman TV, Northerly part of Dow Towers and portions of the abandoned railroad right-of-way are served by a storm sewer which is on private property with easements to the City. Unless permission were given by the City to build over this storm sewer, a building could not be constructed over the pipe. It would be costly to relocate the drainage pipe and inlets so as to provide the necessary storm sewer drainage for all this property. (see attached storm sewer map). E. No person shall stop, park, or leave stan:ling any vehicle on any street or highway in this municipallty in front of the entrance to, or exit from, any theater, dance hall, church, hospital, school, or any hotel having twenty-five or more rooms, for the full width of such entrance or ex1 t during the hours that such buildings are in use by the public. After initial approval by the Council, the owner of any such wilding used for said purposes shall cause to be placed at such entrance or ex1 t, one hour before such building is opened to public use, proper, adequate and. visible signs subject to the approval of the Chief of Pollee, giving notice to the publlc of their hours of use of such building. Such signs shall be removed when such use by the building ceases. Subd.. 38. Parkinp; in Alleys. No person shall park a vehicle or Il rmit it to stand, whether attended or unatterrled, upon any alley within this municipali ty I provided that this shall not prohi bi t the parking of such vehicles for less than a period. of one hour along any such alley for the purpose of having access to any property abutting thereon for the pw:- pose of loading or unloading merchandise or other material when such access cannot conveniently be secured upon the property i tool! . . Subd.. 39. Limited Time ParkiM Zones. The Council may designate no parking or 11mi ted time parking zones by a resolution setting forth the location of the zone, and in the case of a l1m1 ted the parking zone, the time llmit imposed. The Chief of Police shall post signs at locations so designated which shall either indicate, in accordance with the resolu- tion, a no Parking zone or the specified time 11mi t for parking, ani if there is a concrete curb, the curb shall be painted yellow at the desig- nated parking zone. Subd.. 40. Operation am Parkinp: of Vehicles on Private Parkinp: Bots. No person shall operate a motor vehicle on any pri va te parking lots wi thin this municipa.l1ty at a speed greater than is safe and reasonable under the conditions of tra:f'fic then existing therein, and. in no event at a speed exceeding 15 miles per hour. Parking of vehicles on such lots shall conform to any stalls or positions for parking designated on the surface of the parking area am no vehicle shall be parked or allowed to stand in any area of such parking lot which has been designated or is used for a lane for moving traffic so as to interfere with the movement of traffic
