A regular meeting of the Hopkins Zoning and Planning CoIIrission was held on Tuesday.
July 26. 1983. at 7:30 p.m.. in the Council Chambers of the City Hall.
Present were Chair Eddy. members Berg. Folk. Janke. Kirscht. Hilbert and Tickle.
Also present were City Manager Craig. City Engineer Strojan. Community Development
Director Kerrigan and Assistant Community Development Director Norris.
Item: Mrs. Tickle moved and Mr. Janke seconded a motion that the minutes of the
1-4 June 28. 1983 meeting be approved and signed. Motion carried.
Case No: Hearing on an application by Foster Merrill for Waiver of the Platting
83-24 Requirements to facilitate division of two parcels of land into four parcels
5-246 at 315-317 & 321-323 Van Buren Avenue North.
Case No: Hearing on an application by Foster Merrill for lot area. lot width and side
83-25 yard variances for two existing structures at 315-317 & 321-323 Van Buren
Avenue North.
Mr. Merrill explained the request to the Commission to facilitate sale of
property.
Discussion regarding future prOblems such as joint water lines. fire walls.
lot lines. access. maintenance. etc. which should be studied by the staff
to what direction the City should take.
Mr. Folk moved and Mrs. Tickle seconded a motion to continue Cases 83-24
and 83-25 until the next meeting to give staff time to put together infor-
mation on 0 lot lines. condomizing property and such related problems.
Motion carried unanimously.
Case No: Hearing on an application by Centurion Company for a Conditional Use Permit
83-26 to construct special purpose fences at Lake Street N.E. and Van Buren Avenue
262-334 between housing units to provide individual patio privacy.
Mr. Hawks explained the request to the Commission for the 5' fences for the
42 homes in the Auburn South Addition.
Mr. Berg moved and Mr. Janke seconded I motion recommending to the Council
approval of the Conditional Use Permit for the 5' privacy fences. Motion
carried unanimously.
Case No: Hearing on an application by Roof Development Properties for a variance from
83-27 rear and sideyard setback requirements to construct a garage at 44 - 5th
353-484 Avenue North.
Mr. Tom Roof explained the request to the Commission and stated that the place-
ment of the garage at this particular point is less restrictive to adjoining
property than it would be if it were back further.
Mr. Folk moved and Mr. Berg seconded a motion recommending to the Council
approval of the rear and sideyard variances as alternatives would have a
more adverse affect to the property. Motion carried. Mr. Hilbert and
Mr. Janke voting nay.
Case No: Hearing on an application by Clipper Lawn & Landscape for a Conditional Use
83-28 Permit for open storage lot and construction of 6' fence on Lot 2. Block 2.
487-609 Hopkins Industrial Park.
Mr. Earl Dahlberg. representing the owner of the property. and Mr. Manthei i
president of Clipper Lawn & Landscape reviewed the request with the Commission.
Mrs. Tickle moved and Mr. Milbert seconded a motion recommending to the Council
approval of the Conditional Use Permit for the open storage lot and special
use fence. Motion carried unanimously.
Hearing on an application by Kentucky Fried Chicken for a Conditional Use
Permit for remodeling over $75.000 and addition of drive-in window at
1728 West Excelsior Avenue.

Helen Wallen and Jurij Ozga of Kentucky Fried Chicken reviewed the plans with
the Commission.
Residents of the area. Steve Wright. Florence Michels and Harold Lorence
spoke in regard to litter in the area. congested intersection. snow removal
problem due to fence to be installed and traffic hazard.
Mr. Berg moved and Mrs. Tickle seconded a motion recommending to the Council
approval of the Conditional Use Permit for remodeling and addition of a
drive-in window for Kentucky Fried Chicken contingent on the parking change.
staff approval of a refined landscape plan and the woven wire fence to have
wood lath rather than plastic. Motion carried unanimously.
Item: Proposed changes to ordinance relating to non-conforming uses continued
299-388 from the June 28. 1983 meeting.
It was the concensus of the Commission that the City Attorney be instructed
to prepare a draft ordlnance relating to non-conforming uses for approval
at some future date.
Item: Study of application of various communities relating to variances continued
389-391 to the August 30. 1983 meeting.
Item: Proposed landscape guidelines continued to August 30. 1983 meeting.
