1. Applicant is proposing to construct a garage to south of existing structure
at 44 Fifth Avenue North, an R-4 District. Proposed garage is to be 31 from
the south (side) property line and 231 from the west (rear) property line.
The property to the south is occupied by a multiple dwelling unit structure.
2. Ordinance 427.08(F) states that a detached accessory building that is located
less than 60 feet from the front lot line shall conform to the yard require-
ments of the prinCipal building. Proposed garage would be approximately 401
from front lot line; the required side yard for this structure is 151 and the
required rear yard is 251. Applicant is requesting a variance of 121 for the
side yard and a variance of 21 for the rear yard.
3. Ordinance 427.23(3) states that a variance be granted in cases where literal
enforcement of the ordinance would cause undue hardship to the owner due to
circ~stances unique to the property in question. The applicant has stated
that a variance is necessary due to the sloPtof the lot.
