Subject: Conditional Use Permit to remodel existing building at a cost over
$75,000 in accordance with 427.26 and addition of a drive-in window.
STAFF FINDINGS & COMMENTS: Kerrigan
1. The applicant is proposing to remodel the existing Kentucky Fried Chocken
establishment 1728 Excelsior Avenue West. As the improvements will exceed
$75,000, 427.26(c) requires approval of a Conditional Use Permit.
2. Both the exterior and interior of the structure are to be remodeled and
updated. The existing size of the structure is not to change. On the
interior 24 seats (6 booths, 4 person capacity) are to be installed.
3. A drive-in window is proposed to be added to the east side of the building.
Entrance to the drive-in lane is to be on the southwest corner of the lot off
of 18th Avenue. The present Excelsior Avenue exit/entrance would become an
exit only point. 427.36F requires that a drive-in business have a vehicular
storage lane of sufficient capacity to accommodate 15 minutes of service be
provided for each service station. From the plan presented, it appears that
the storage lane on the site would be able to accommodate 5-6 vehicles. This
probably would be sufficient except for possibly peak hours. In that it is
difficult to determine adequate storage capacity prior to actual operation,
if approved the Commission could require a review of the CUP as relates to
the drive-in window a year after operation.
4. Additional landscaping of the site is to be provided. The plans had not been
completed prior to the review but the applicant has stated that it would be
available to staff prior to the meeting.
5. In accordance with 427.44(4) a fence is to be provided along the entire south
border line to separate the parking area from adjacent residential.
6. Two light standards are to be provided in the parking lot. They would be re-
quired to comply with 427.44(2) of the ordinance which states that all lighting
used in off-street parking areas shall be shaded or diffused so as to reflect
the light away from the adjoining property and away from abutting traffic.
7. The trash area presently located at the southeast corner is to be relocated
along the south wall of the building.
8. As the drive-in lane runs parallel between the parking area and the building,
if approved the applicant should provide a marked pedestrian area and proper
crosswalk signage.
9. The plan as proposed details new signage. Any approval of a CUP still would
require the applicant to make application for sign permit and meet all require-
ments of the ordinance as relates to signs.

10. Five parking spaces are to be removed to facilitate the drive-in lane and as
a result of a change to angle parking. The plan as originally presented showed
18 parking spaces. 427.45 of the ordinance requires restaurants to provide at
least one (1) space for each three (3) seat based on design capacity. As the
design capacity is to be 24 seats, 8 parking spaces would meet this requirement.
In addition, the drive-in service window would require five (5) parking spaces
thus a total of 13 spaces would be required, and 13 spaces are shown to be provided.
