Finke, Jr. Location: Lot 4, Block 17, West Minneapolis Center Subject: Waiver of the Plat STAFF FINDINGS AND COMMENTS: Kerrigan 1. In 1945 the owners of Lot 6 7, West Minneapolis Center, the car wash property located at 613 East Excelsior Avenue was granted an easement for ingress and egress over the southerly 3 feet of Lot 4, Block 17. across the northerly half of the vacated alley adjacent and contiguous to Lot,4,_West Minneapolis which is now the location of Advanced Packaging Corp. Basically, this easement facilitated access to the car wash site from Harrison Avenue. 2. When the Conditional Use Permit for the new car wash was approved, access was stated to be limited to an on -site point. However, when recently the car wash owners requested a change to the Conditional Use Permit to allow an access point off of Harrison Avenue, Advanced Packaging Inc. voiced a concern that the increased traffic flow through this point created by the larger scale car wash would be detrimental to access to Advanced Packaging Inc. Thus the request for a Waiver of the Plat is a compromise to meet the needs of both of these businesses. 3. As a result of the request 10 feet directly north of the property of the car wash would be transferred to the car wash ownership (7 foot vacated alley easement and 3 feet of Lot 4). In return for this property the owners of the car wash property would agree to terminate their easement rights over the 10 feet (3 feet of Lot 4 and 7 feet of vacated alley) directly east of the extnesion of the easterly lot line of Lot 6 to the westerly right -of -way line of Harrison Avenue. 0 Proposed Lot Division for Hopkins Car Waah EXHIBIT D a ....4. &.4./.ci.b.
