ORDINANCE NO. 83 -532
AN ORDINANCE AMENDING SECTION 140.00 OF THE
HOPKINS CODIFIED ORDINANCES, REGARDING DISPOSAL
OF PROPERTY
BE IT ORDAINED by the City Council of the City of Hopkins as follows: that
existing Section 140:00 is hereby repealed, and replaced with the language below:
Section 140 Custody and Disposal of Unclaimed and Surplus Property
Section 140:00
Subd. 1. Personal Property. Whenever any personal or chattel property of any nature
or description shall have lawfully come into the possession of the City of Hopkins in the
course of its municipal operation, including the seizure or confiscation thereof by the
police of the City of Hopkins or by any other officer or employee of such City and such
property has remained unclaimed by the owner and has been in the possession of the
municipality continuously for a period of at least sixty days, such property may be ordered
sold by motion of the City Council to the highest bidder at public auction.
Subd. 2. Notice of Sale. Two consecutive weeks _,published notice shall be given in
the official newspaper of the City of Hopkins that such property will be sold in public
auction, such sale to be held not less than six (6) days following the date of the last
publication.
Subd. 3. Content of Notice. Each notice shall contain a general description of the
items of property thus to be sold; the general manner under which such property came
into the possession of the City of Hopkins and the time and place of such sale.
Subd. 4. Sale, How and by Whom Made. The sale shall be made by the City Manager or her/
his deputy at public auction to the highest bidder.
Subd. 5. Postponement. Such sale may be postponed from time to time by inserting
a notice of such postponement as soon as practicable in the neswpaper in which the original
advertisement was published and continuing such publication until the time to which the
sale is postponed.
Subd. 6. Certificate of Sale. When any sale of such property is made, the officer
shall make and deliver to the purchaser a bill of sale containing a description of the
property sold, and the price paid for each item.
Subd. 7. Proceeds of Sale. All proceeds of such sale shall be deposited by the
City Manager in the general fund of the City. At any time within six months from the
date of such sale the former owner of any item of such property may make application
to the City for payment to him of the proceeds of such sale and after satisfactory proof
of such ownership furnished to the City within six months from the date of such sale,
the City Council shall order the sale price to be paid to such former owner, after
deducting therefrom the actual or reasonable costs and expenses necessarily expended by
the City in the conduct of such sale, and the storage and care of such property.
Subd. 8. The provisions of this ordinance shall not apply to dogs, cats, or any
other domestic animal impounded as in the statute or other ordinances provided.
First read at a regular meeting the City Council of the City of Hopkins held November 1,
1983, and finally read, approved, adopted and ordered published at a regular meeting of
said Council on November 15, 1983.
