Minutes 8-17-09A regular meeting of the Council of the City of Hopkins, Minnesota was held on Tuesday, August 17, 1982 in the Council Chambers of the City Hall, at 7:30,p.m. Present were Mayor Miller, Councilmembers, Lavin, Milbert and Shirley. Mrs. Arimond was absent. Also present were City Manager Craig; City Clerk Renne; Assistant City Engineer Anderson; Public Works Operations Director Beecher; Assistant Director of Community Development Norris; and City Attorney Vesely. Reel 183 Side 1 MINUTES: LICENSES: BILLS: HEARING: Hearing on Resolution no.. 82 -3014 "RESOLUTION ADOPTING SPECIAL ASSESSMENTS FOR THE IMPROVEMENTS OF CERTAIN STREETS, AVENUES, HIGHWAYS, ALLEYS, AND THOROUGHFARES, ALL MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED ACTION: Mr. Shirley moved and. Mr. Milbert seconded the motion to adopt the resolution. A poll of the vote was as follows: Mrs. Lavin, Aye; Mr. Milbert, Aye; Mr. Shirley, Aye; Mayor Miller, Aye. The motion carried unanimously. HEARING: Resolution No. 82- 3018 "RESOLUTION GIVING PRELIMINARY APPROVAL TO A PROJECT UNDER THE MUNICIPAL INDUSTRIAL DEVELOPMENT ACT: REFERRING THE PROPOSAL TO THE COMMISSIONER OF ENERGY, PLANNING AND DEVELOPMENT FOR APPROVAL: AND AUTHORIZING PREPARATION OF NECESSARY DOCUMENTS ACTION: ITEM 82 -116 -0 ACTION: ITEM 82 -102 -0 Ordinance No. 82- 514 "AN ORDINANCE AMENDING SECTION 409 OF THE HOPKINS CODE OF ORDINANCES WHICH PERTAINS TO SIGNS AND PLACARDS ACTION: ITEM 82 -104 -J ACTION: Mr Shirley moved and Mrs. Lavin seconded the motion to approve the minutes of the August 3, 1982 meeting. A poll of the vote was as follows: Mr. Shirley, Aye; Mr. Milbert, Aye; Mrs. Lavin, Aye; Mayor Miller, Aye. The motion carried unanimously. Mrs. Lavin moved and Mayor Miller seconded the motion to additional 1982 miscellaneous license applications (list A poll of the vote was as follows: Mrs. Lavin, Aye; Mr. Mr. Shirley, Aye; Mayor Miller, Aye. The motion carried approve the attached). Milbert, Aye; unanimously. Mr. Milbert moved and Mrs. Lavin seconded the motion to approve and authorize for payment warrant 647, dated August 17, 1982 in the amount of $288,107.06. A poll of the vote was as follows: Mr. Shirley, Aye; Mr. Milbert, Aye; Mrs. Lavin, Aye; Mayor Miller, Aye. The motion carried unanimously. Ordinance No. 82 -516 "AN ORDINANCE AMENDING CHAPTER V, SECTION 500:00 OF THE CITY OF HOPKINS 1977 CODE OF ORDINANCES RE: LIQUOR LICENSE FEES AND VARIOUS LICENSE FEES." Mrs. Lavin moved and Mr. Shirley seconded the motion to accept Ordinance No. 82 -516 for first reading. A poll of the vote was as follows: Mrs. Lavin, Aye; Mr. Milbert, Aye; Mr. Shirley, Aye; Mayor Miller, Aye. The motion carried unanimously. Mr. Milbert moved and Mrs. Lavin seconded the motion to accept Ordinance No '.82 -514 for first reading, but to include a reference to No. 670 subdivision 1 H in the context for second reading. A poll of the vote was as follows: Mr. Shirley, Aye; Mr. Milbert, Aye; Mrs. Lavin, Aye; Mayor Miller, Aye. The motion carried unanimously. List of election judges for September 14, 1982 primary election. Mr. Milbert moved and Mrs. Lavin seconded the motion to approve the list of election judges. A poll of the vote was as follows: Mr. Shirley, Aye; Mr. Milbert, Aye; Mrs. Lavin, Aye; Mayor Miller Aye. The motion carried unanimously. ITEM 82- 118 -0 Ordinance No. 515 "AN ORDINANCE AMENDING THAT PART OF SECTION 400 OF THE HOPKINS CODE OF ORDINANCES PERTAINING TO THE LICENSING OF VENDING AND OTHER AMUSEMENT DEVICES IN LICENSED PREMISES ACTION: Mrs. Lavin moved and Mr. Milbert seconded the motion to accept Ordinance No. 515 for first reading. A poll of the vote was as follows: Mrs. Lavin, Aye; Mr. Milbert, Aye; Mr. Shirley, Aye; Mayor Miller, Aye. The motion carried unanimously. Q page 2 Minutes of Hopkins City Council August 17, 1982 ITEM 82 -119 -0 Ordinance No. 82 -517 "AN ORDINANCE AMENDING THAT PART OF HOPKINS ZONING ORDINANCE NO. 427 PERTAINING TO AND CHANGING THE ZONING OF THE EAST HALF OF THE SW% OF SECTION 25, TOWNSHIP 117, RANGE 22, AND LOTS 1 -30 INCLUSIVE BLOCK 1, DAVISON'S ADDITION TO WEST MINNEAPOLIS AND ALSO A PORTION OF THE NORTH HALF OF THE NW% OF SECTION 19, TOWNSHIP 117, RANGE 21; AND ALSO VACATING PLAT, STREETS, AND ALLEYS THEREIN. ACTION: ITEM 82 -120 -C Memo from Jim Kerrigan, Community Development Director, regarding the moving and sale of the former Historical Society house. ACTION: Mr. Shirley moved and Mayor Miller seconded the motion to approve the recommendation by staff for moving and sale of the former Historical Society house. A poll of the vote was as follows: Mr. Shirley, Aye; Mr. Milbert, Nay; Mrs. Lavin, Aye; Mayor Miller, Aye. The motion carried. ITEM 82 -122 -R ACTION: ITEM 82 -123 -R ACTION: Mr. Milbert moved and Mrs. Lavin seconded the motion to accept Ordinance No. 517 for first reading. A poll of the vote was as follows: Mr. Shirley, Aye; Mr. Milbert, Aye; Mrs. Lavin, Aye; Mayor Miller, Aye. The motion carried unanimously. The Council requested that before anything_is done regarding this matter that it is brought back before the Council for further approval and they would like more information from Mr. Kerrigan. ITEM 82 -121 -R Resolution No. 82- 3015 "A RESOLUTION ORDERING ABATEMENT OF NUISANCE BY REMOVING CERTAIN INFECTED ELM AND /OR OAK TREES IN VARIOUS LOCATIONS IN THE CITY OF HOPKINS". ACTION: Mr. Shirley moved and Mrs. Lavin seconded the motion to adopt the resolution to set a hearing for September 7, 1982. Resolution No. 82 -3016 "RESOLUTION DECLARING COSTS TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENTS Mrs. Lavin moved and Mr. Milbert seconded the motion to adopt the resolution. A poll.of'the vote was as follows: Mr. Shirley, Aye; Mr. Milbert, Aye; Mrs. Lavin, Aye; Mayor Miller, Aye. The motion carried unanimously. Resolution No. 82 -3017 "RESOLUTION FOR HEARING ON PROPOSED SPECIAL ASSESSMENTS Mrs. Lavin moved and Mr. Shirley seconded the motion to adopt the resolution setting a hearing to be held on September 21, 1982. A poll of the vote was as follows: Mrs. Lavin, Aye; Mr. Milbert, Aye; Mr. Shirley, Aye; Mayor Miller, Aye. The motion carried unanimously.
