STAFF FINDINGS COMMENTS: Kerrigan
1. The subject site is the location of the former fuel /service station operation.
The applicant is requesting a Conditional Use Permit to utilize the site for
this same use in compliance with 427.33(1) which states that a Conditional Use
Permit shall expire one year after it has been issued unless the use for which
the permit has been granted is in effect, except that, upon written application
of the owner of the affected land for which the permit was granted prior to the
end of said year,may request and the Council may grant an extension not to exceed
one year.
2. The applicant is proposing no major alterations to the existing structure.
3. The applicant is proposing to eliminate two of the existing four curb cuts
presently providing access to the parcel. This improvement should aid in
retaining acceptable traffic patterns in this area.
4. The applicant is required to comply with all the requirements of 427.36(M)
including the following:
a) 10' landscaped front yard setback is to be provided. This area should
be sodded and planted according to an acceptable landscape plan submitted
to staff.
b) 427.36(M) (g) requires that if a station is self- service each pump island
shall accomodate six vehicles in a storage lane in addition to those
accomodated at the island. The proposal as detailed would be able to
meet this requirement if the vehicles entered the island off 17th Avenue.
However, it would be difficult to meet such a requirement for the vehicles
entering off Excelsior Avenue thus, it would be most appropriate to require
the applicant, if approved, to post the curb cut on Excelsior Avenue for
exiting vehicles only. The applicant should also be made aware that it
would be his responsibility to enforce this situation.
c) 427.36(M) (b) requires that the entire site not covered with building or
landscaping shall be hard surfaced. The northwest corner of the site is
presently gravel and thus must be brought into compliance with this section
of the ordinance.
5. To date the Fire Marshal has not reviewed the plans as presented.
6. Eight off street parking spaces are to be provided on the east side of the site.
427.45(17) requires that motor fuel stations provide at least (4) off street
parking spaces plus two (2) off street parking spaces for each service stall.
Thus the plan as presented has sufficient parking and provided in section 427.43.
