Recommendation for Approval of App. by 1st Bank System (CUP for bank facility 1109-1125 E. Excelsior Ave)August 26,1982 Case No: 82 -37 Applicant: First Bank System Location: Parking lot of Hopkins Commerce Center Request: Conditional Use Permit for free- standing bank facility in a B -3 District STAFF FINDINGS COMMENTS: Norris Kerrigan 1. Applicant is requesting a Conditional Use Permit to construct a free- standing bank facility in the southeast corner of the paved surface in front of the Hopkins Commerce Center at Blake Road and Excelsior Avenue East. The site is a separate lot from the commerce center, and is presently vacant with no desig- nation for parking. The site is in a B -3 district. The applicant is not pro posing any new access points from what presently exists. 2. The proposed facility is to be 136 square feet, with half of the area to be used as a lobby, and the other half for service area. The lobby will house a 24 -hour automatic teller machine. Ordinance 427.36 states that banks and savings may be located in a B -3 district only with a Conditional Use Permit provided that the land for that use abutts or is separated only by a public right -of -way from a B -2 district which in this case does not exist. However, the proposed structure does not seem to fit into any of the descriptions of permitted uses in a B -3 district, including banks and savings and loan institutions. 3. Ordinance 427.35 requires that sites fronting county roads have a minimum front setback of 20 feet. On the site plan submitted, applicant has a minimum front setback of 30 feet. 4. Applicant is proposing the installation of 6 parking spaces outside the facility. Due to insufficient information, it is not clear whether the Hopkins Commerce Center presently has enough parking according to Ordinance 427.45. In the past, however, there seems to have been adequate parking provided as relates to actual use. Furthermore, because the Hopkins Commerce Center and the proposed facility are on seperate lots, their parking requirements would be considered individually. 5.
