Report on Block 4 Park Valley Addition (Request by Gorhams)REPORT ON REQUEST TO PURCHASE
CITY PROPERTY
The City Council on September 28, 1982, referred to the Engineer for
a report on a request by Gene and Melanie Gorham to purchase a portion of
Block 4, Park Valley Second Addition. The purpose of the request (see
letter attached) was to construct a two car garage on the east side of
their home which is located at 220 Seventh Street South.
Sheet 1 (attached) shows the locaton of the home (220 -7th St.So.)
on Tract E, R.L.S. No. 939. Building permit records show the home is
located 9 feet from the east line of Lot E. Sheet 1 also shows the
location of Block 4, which is a 40 foot strip of land owned by the City
of Hopkins. Sheet 2 (attached) shows the location of a 48" storm sewer
pipe in the approximate center of the 40 foot strip. This pipe is the
outlet for a storm .sewer system serving a section of the Park Valley
neighborhood and includes drainage from the land occupied by Hennepin
County Highway Department and the Country Club warehouse.
If a detached garage is constructed it would have to be 6 feet from
the home. Assuming a 24 foot wide garage, this would mean that 3 feet of
the garage would be on private property (Tract E) and 21 feet would be on
the -City owned 40 foot strip. This would result in having the easterly
portion of the garage constructed over the 48" storm sewer.
The City does have several instances where buildings have been con-
structed over existing storm sewer pipes. This is not desireable as it
presents a maintenance problem to the City and a potential danger to the
structure due to sewer collapse or blockage. The property owner would
have to indemnify the City against any claim for damage due to sewer fail
ure. Another possibility would be to relocate the storm sewer to the east.
This would cost an estimated $3000.
An easement to construct a garage which includes the above protection
clause for the. City could cause problems for future sale or in securing
mortgage loans.
The recommendation for Council consideration would be to not sell or
grant an easement over a portion of the 40 foot strip of land.
The letter asks if a driveway could be run alongside of the home so
that a garage could be constructed in the back yard. A driveway on the
westerly portion of the 40 foot strip of land would present no problem to
the City as the driveway would then not even be located over the pipe.
