ORDINANCE NO. 82 -503
LICENSING AND REGULATING SWIMMING
POOLS IN THE CITY OF HOPKINS
BE IT ORDAINED by the City Council of the City of Hopkins as follows
Section I DEFINITIONS. The following definitions shall apply in
the interpretation and enforcement in this Ordinance and the following words and
terms wherever they apply are defined as follows:
(1) Health Authority shall mean the duly appointed health
officials of the City of Hopkins.
(2) Health Department, Health Officer, State Board of Health,
or Board, used at any place in this Ordinance and in the
requirements adopted by reference shall mean the Health
Authority of Hopkins.
(3) Person shall mean any individual, natural person, firm, Corporation,
Association, Organization, Partnership, Business Institution,
Agency, or any Federal, State or local government agency
or instrumentality or other entity recognized by law as
the subject of rights and duties, and shall include, but
not be limited to, employees, licensees, tenants, caretakers,
lessees, managers and operators of swimming pools.
(4) Swimming Pool shall mean any structure, basin, chamber,
or tank containing an artificial body of water for
swimming, diving, relaxation or recreational bathing.
(5) Public Swimming Pool shall mean any swimming pool, other
than a private residential. pool, intended to be used
collectively by numbers of persons for swimming and bathing,
operated by any person as defined herein, whether he
be an owner, lessee, operator, licensee, or concessionaire,
regardless of whether a fee is charged for such use.
Section II LICENSE REQUIRED No person shall own, operate, maintain,
lease, or be responsible for any public swimming pool unless a license therefor
issued pursuant to this Ordinance shall have been obtained from the City of Hopkins.
Wherever more than one pool is located upon any property, a separate license shall
be obtained for each pool.
Section III LICENSE FEES: The license fee for each public swimming
pool shall be in the amount which the City Council shall from time to time
establish by proper Resolution.
Section IV LICENSE EXPIRATION AND RENEWAL: Licenses issued pursuant
to this Ordinance shall expire on the 31st day of December of each year. License
renewal applications shall be filed with the City Clerk prior to January 1 of each
year.
Section V LICENSE APPLICATION, ISSUANCE, MAINTENANCE AND ADMINISTRATION.
All applications for public swimming pool licenses shall be made on forms furnished
by the City, Manager and shall set forth such information as the City shall from time
to time require.
Section VI RULES AND REGULATIONS PERTAINING TO CONSTRUCTION, CARE
AND OPERATION OF PUBLIC SWIMMING POOLS: All public swimming pools as defined in
this Ordinance shall be operated, governed and regulated by all of the provisions and
all regulations established and issued by the Minnesota State Board of Health as
contained in its Regulation MHD 141, all of which provisions of said Regulation
MHD 141 are hereby enacted and adopted as a part of this Ordinance by reference
which provisions shall have the same force and effect as though all of such
regulations were herein set forth verbatim. Two copies of the Minnesota State
Board of Health Regulations MHD 141 shall be on file for public inspection at
the office of the Hopkins City Manager and of the City Clerk. In addition to
all other Ordinances as hereinabove set forth, such swimming pools shall also be
regulated, governed and controlled by any and all other Ordinances and
Regulations enacted or adopted by the City of Hopkins, which Regulations may be
passed and adopted by proper Resolutions of the City Council.
Section VII INSPECTION OF PUBLIC SWIMMING POOLS. The Health
Authority designated by the City or the_State of shall inspect
swimming pool as frequently as may be necessary or desireable to insure compliance
with the provisions of this Ordinance and Regulations issued thereunder.
Section VIII REVOCATION OF LICNSEa Any license issued under this
Ordinance may be revoked by the City Council for a violation of any provision of
this Ordinance or of any rule or rules issued and adopted thereunder.
Section IX PENALTY: Any person violating any provision of this
Ordinance shall be guilty of a misdemeanor.
First read at a regular meeting of the Council of the' City, of -Hopkins
held on March 16, 1982, and finally read, approved, adopted and ordered published
at a regular meeting of said Council of said City on April 6 198
