Request: Rear yard variance to modify existing garage
STAFF FINDINGS AND COMMENTS: Norris Kerrigan
1. Applicant is proposing an addition of 17'x20' to existing garage of 15'x20'.
This proposed addition would decrease rear yard from existing 26' to 9'.
Side yard would remain at existing 5'.
2. Ordinance 427.31 states that minimum rear yard for R -1 -A is 25 feet. Ordin-
ance 427.31 also states that the side yard for additions to any existing
dwelling shall be the same or greater than the existing structure, except
that no side yard shall be less than 5 feet.
3. Applicant is requesting the following variance: a rear yard of 9' (an
encroachment of 16').
4. Ordinance 427.23 states that variances shall be approved only by circumstances
unique to the property under consideration would cause undue hardship to owner.
The applicant has stated that proposed addition is only possible option avail-
able for expansion of existing garage due to location of existing structure,
and that he requires the additional space for vehicle storage.
