STAFF FINDINGS COMMENTS: Kerrigan Norris
1. The applicant presently has a single family dwelling in an area zoned
R -1 -A.
2. The zoning ordinance requires 3500 sq. ft. of lot area per family in an
R -1 -A area or 7000 sq. ft. for a two family unit. The subject site contains
6150 sq. ft.
3. 427.04(108) states that a variance be granted only because of undue hardship
due to circumstances peculier and unique upon such parcel. The applicants
reason for his request is the "detrimental reliance on two family dwelling
zoning district and considerable number of duplexes in surrounding area."
4. In 1979 the Zoning and Planning Commission received a variance application
to allow the construction of a duplex on the subject property. This request
was denied by the Commission.
5. A petition from the surrounding neighbors of the subject property has been
received by the City opposing the request.
6. Attached are various actions which have previously occurred as relates to
the subject parcel and its use for a two family dwelling unit.

construct a double residence at 330 12th Avenue North. We, the undersigned,

present request for a variance to allow a double residence at the above
