Request: One foot sideyard variance to construct a garage addition.
STAFF FINDINGS AND COMMENTS: Kerrigan Norris
1. The subject property is zoned R -1 -C. The applicant is requesting a side
yard variance to construct a 16'x16' addition onto his existing 15.5x22
garage.
2. The ordinance requires a 10' side yard for a story dwelling in an R -1 -C
District. However, the side yard for additions to any building dwelling
shall be the same or greater than the existing structure, except no side
yard shall be less than five feet. The existing and proposed garage
sideyard would have a four foot sideyard setback.
3. The applicant has submitted the signature of five surrounding property
owners who are not opposed to the proposal.
4. 427.04(108) states that a variance be granted only because of undue hard-
ship due to circumstances peculiar and unique upon such parcel.
