CUP- 18th Ave & Excelsior AveApril 20, 1982 Case No: 82 -12 Applicant: Harold Stiele Location: 18th Avenue North Excelsior Avenue Request: Conditional Use Permit to construct a building costing over $75,000 STAFF FINDINGS AND COMMENTS: Kerrigan Norris 1. The subject property is located at the northeast corner of Excelsior and 18th Avenue North. 2. The applicant is requesting a Conditional Use Permit to construct a 40'x60' block building. The sides of the proposed structure fronting on Excelsior Avenue and 18th Avenue would be a decorative block. All entrances as well as two garage doors would be located on the west wall. Building height would be approximately 14'. 3. The plan as submitted shows six parking spaces on the west side of the building but the applicant has stated this plan will be revised to show 8 spaces. How- ever, in accordance with 427.45 12 spaces would have to be provided. The applicant is presently requesting a variance as a result of this deficit. All parking is to be bituminous surface. 4. The subject site dimensions are 80'x80'. 427.04(64) states that if a corner lot is within 10% of being equal, the front lot line shall be the street line designated by the owner and filed in the office of the Building Inspector. The applicant would have to designate the Excelsior side of the building dS the front yard in order to comply with the setback requirements of the ordinance. Under the designation the setbacks would be as follows: Front Yard 10'0" West Side Yard 39' East Side Yard 1' Rear Yard 10'0" These setbacks all comply with the requirements of the ordinance. 5. The landscape as shown is only on the west side of the development. If approved it is recommended that the applicant submit a revised landscape plan acceptable to the staff detailing landscaping also on the Excelsior Avenue side of the structure. A sodded greenway perimeter is shown on all but the east side of the structure. 6. The Fire Marshal has reviewed the plans and has stated that is accordance with the current Uniform and National Fire Code the proposed structure would have to be sprinkled. 7. The trash plan as proposed would consist of two dumpsters along the west side of the structure. It is recommended that both dumpsters be placed in the rear of the building (north side) and that an acceptable decorative enclosure be con- structed to conceal them from view. Case No: 82 -12 Page 2 8. Access to the site would involve curb cut along 18th Avenue. 9. The applicant has stated all storage would be inside the proposed structure. 10.
