STAFF FINDINGS AND COMMENTS: Kerrigan Norris
1. The east /west boundary of Burns Park is presently open to the south. The City
is requesting a special purpose fence to provide a barrier between the Park
and the adjacent residential use located at the southeast corner of the park.
2. 427.22(d) states that fences along a rear property line which constitutes the
side lot line of an abutting lot shall not exceed six (6) feet in height for
a distance calculated as in 427.11(b) of the ordinance and shall not exceed
three and one -half (32) feet in height thereafter. The City is proposing the
fence to be six feet in height the entire distance from the easterly boundary
of the Park until approximately the intersection of the Park and Park Lane.
The fence as proposed would be cyclone.
3. The City Council earmarked funds in the 1982 Park and Recreation Budget for
this improvement.

SUBJECT: Special use Permit for Fencing at Burnes Park
It is the direction of the Hopkins City Council that the
City install a six- foot -high chain link fence along the
south property line of Burnes park, to protect the pri-
vacy of the two adjoining property owners.
The fence to be installed will be on or near the park
property line, from the south /east corner of the park
to approximately 245 feet westerly. The most western
point will coincide with the westerly end of the existing
hedge.
It is my understanding that a portion of this fence that
parallels the Reuter residence, 141 Park Lane, requires
a special use or special purpose permit, because of its
height. It is this special permit that is requested.
Attached is a letter from Steven Reuter and Patricia Reuter
consenting to the six -foot height, in addition to other
conditions.

This letter is being submitted to express the written consent
of Steven F. Reuter and Patricia P. Reuter for the Hopkins Minnetonka
Recreation Department to:
1. Install a 6 (six) foot high chain link fence bordering
Burnes Park and 141 Park Lane.
2. That the aforementioned fence be installed on the park
property, running parallel to the bushes, leaving the
bushes as they are rooted.
3. That the property south of the fence will be maintained
by the residents of 1 Park Lane,

With regard to our phone conversation on 7- 16 -80, we formally
request the park department to install a cyclone fence along
the south boundary of Burnes Park and 141 Park Lane, Hopkins.
As stated in our phone conversation, we are concerned about
our property and physical safety because of unpredictable
activities in Burnes Park.
We appreciate your cooperation in this matter.
