STAFF FINDINGS AND COMMENTS: Norris Kerrigan
1. Applicant is requesting a Conditional Use Permit to construct a planned Unit
Development of 32 attached townhouses. Proposed site is at the southwest
corner of 9th Avenue 7th Street South, in an R -2 District.
2. A substantial portion of the site is located in the Nine Mile Creek Flood
Plain. All plans must be approved by the Nine Mile Creek Watershed District.
3. Applicant is proposing 14 units to front on 7th Street South, two buildings
of 4 units and one building of 6 units, and 18 units, two buildings of 4 units
and two buildings of 5 units facing 9th Avenue South. All units are to be two
story, approximately 21' in height with two bedrooms, totalling 1008 square feet
per unit. There will be 5 one -story (approximately 12 feet in height) storage
units, each to be 14'x38' and each containing 20 lockers. These units are to be
located among the units. Units are located 35' from front and side lot lines in
accordance with 427.31.
4. Parking is provided behind the units. Access to the parking is from 9th Avenue
South and 7th Street South. There are 52 spaces provided. According to 427.45
(1) as it presently exists, 32 parking spaces would be provided. However, if
the Zoning and Planning Commission and Council approves the amendments for
residential parking requirements as recently considered, 64 parking spaces would
be required.
5. There are three 6'x10' garbage dumpster enclosures provided in the parking area.
6. A landscape plan was submitted which shows an assortment of trees and shrubs to
be planted around the front and sides of the units and around the parking area
in the back. There is also a play area proposed to be located to the rear of the
units, beyond the parking areas. Applicant has proposed a wood chip trail on the
creek easement.
7. The utility and drainage plans have been reviewed by the City Engineer. The
Engineer noted that 9th Avenue South is not wide enough to accommodate on- street
parking.
8. The Fire Marshal has reviewed the plans and noted that either all units must be
sprinkled or fire walls must be constructed between every other dwelling unit.
9. At the August 31, 1982 Zoning and Planning meeting, the Commission looked favorably
on applicants' Concept Review plan and recommneded that the applicant work with
the neighborhood on the building design. The plans submitted with this request
for this Conditional Use Permit are basically the same as those.submitted for the
Concept Review. The previous plan provided 66 surface parking spaces and the present
plan has 52 surface parking spaces and more green space.
