VARIANCE - SETBACK
Proposed Action.
Staff recommends the following motion: Move to deny a setback variance for the
addition to Supervalu and direct staff and the City Attorney to prepare findings of fact to
adopt at the A?ril 19 City Council meeting.
At the Zoning and Planning meeting, Ms. Halverson moved and Mr. Kjos seconded a
motion to adopt Resolution RZ05-11, recommending denial of a setback variance for the
addition to Supervalu. The motion was approved on a 3-2 vote, Mr. Aarness and Ms.
Aristy voting nay.
Overview.
Supervalu is proposing to construct a 130,000-square-foot addition to the existing
building at 300 Second Avenue South. The proposed addition will be located on the east
side of the existing building. The existing parking on the east side of the building will
be relocated to the south side
The applicant has also applied site plan approval and a height variance.

Primary Issues to Consider.
. What does the ordinance require?
The front yard setback for an industrial building is 20 feet.
. What are the specifics of the applicant's request?
The applicant is requesting a setback variance of 10' 4". The northeast comer of the
building is 10' 6" from the property line. The southeast comer of the building will be 23
feet from the property line
. What is the staff recommendation?
Because staff is recommending denial of the site plan and the height variance, the
request for the setback variance can not be granted because there will not be a project.
. What was the discussion at the Zoning and Planning meeting?
The discussion regarding the variance occurred at the site plan discussion.
Alternatives.
1. Approve the variance. By approving the variance, the applicant will be able to
construct the building as proposed. If the City Council considers this alternative,
findings of fact will have to be stated that support this recommendation.
2. Deny the variance. By denying the variance, the applicant will not be able to
construct the addition as proposed.
3. Continue for further information. If the City Council indicates that further
information is needed, the item should be continued.
