ORDINANCE NO. 82 -506
ORDINANCE ESTABLISHING A
SYSTEM OF CONTACTOR LICENSING
WHEREAS, the construction, rehabilitation, remodeling or
alteration of any kind of building involves the public health, safety and
general welfare of the public, and
WHEREAS, unsafe, unstable or dangerous structures from time to
time have been and are being constructed or repaired by inexperienced,
itinerant, careless or fraudulent building trades personnel who lack
sufficient responsibility, and
WHEREAS, it is in the public interest to have a record and control
of building contractors or building trades personnel who may be engaged in
construction work in the City:
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Hopkins as follows:
SECTION 1 CONTRACTORS DEFINED. A building contractor shall mean
and include any person, firm or corporation which furnishes or performs work
in the construction, remodeling, rehabilitation or improvement of any building
or structure for which a City building permit is required which work includes
but is not limited to carpentry, cement work, electrical wiring, masonry,
mechanical excavation, paving, plastering, plumbing, roofing, sheet rock
installation, stucco work and any other related skills or qualifications.
SECTION 2 LICENSE REQUIRED. Except as hereinafter provided, every
main or independent building contractor shall register with and obtain a
license from the City for the performance of any work or improvement for
which a City building permit is required upon any building or structure in
the City.
SECTION 3 CONTRACTOR'S LIABILITY. The license issued pursuant hereto
shall permit or allow the holder thereof to furnish and perform any part or all
of the work, labor and materials required in the building contract, including the
work and requirements set forth in any subcontracts, and each such subcontractor
shall be qualified as and whenever required by State Law. The main or independent
contractor shall be and remain responsible for all of the work required and
performed.
SECTION 4 LICENSE APPLICATION. Such license may be issued to such
contractors upon written application therefor which shall require and contain
proof of such applicants' qualifications and which shall also contain but shall
not be limited to the following information:
A written resume of the experience and ability in the building
trades of the main applicant including such references as the
City may from time to time require.
Evidence of such qualifications may include any permit, license
or certificate issued by any Agency of the State of Minnesota to
the applicant and will be considered as prima facie evidence of the
contractor's competency under this section. Whenever any Agency of
the State of Minnesota imposes licensing or registration requirements
for any trade license under this section, proof of satisfaction of
all State requirements shall be provided with the license application.
b. Accompanying each such application the main or independent contractor
shall further provide the City with evidence or proof of the following:
1. Workman's Compensation insurance owned and maintained by
applicant and /or subcontractor as required by law.
2. Proof by proper certificate or insurance contract that such
contractor and /or subcontractor maintains public liability
insurance in the amount of not less than $100,000.00 per
person and $300,000.00 per accident for bodily injury and
$5,000.00 for any property damage liabilty
c• A performance bond in the sum of $2,000.00 conditioned upon
compliance by such contractor and /or any subcontractors with all
provisions of the building and other construction Codes, Ordinances,
and Regulations governing construction work.
SECTION 5 OWNER RIGHTS AND RESPONSIBILITY. An owner shall not be
required to obtain a license under this Ordinance, personally to perform any
work in connection with his residence or other dwelling and appurtenances
including the right of such owner to engage the services of any Aias or
helpers, provided that such work shall be in compliance with the various
building and other relevant Codes and provided further that such owner shall
be responsible and liable for any losses or liabilities which may arise or
be caused by such construction or by the violation of any requirements under
the applicable Statutes and Ordinances.
SECTION 6 PENALTY. Any person, firm, or corporation violating any
part or provision of this Ordinance shall be guilty of a penal offense.
First read at a regular meeting of the Council of the City of Hopkins
held May 4, 1982, and finally read, approved, adopted and ordered published
at a regular meeting of said Council of said City on May 1 1982.
