STAFF FINDINGS COMMENTS: Rafferty Kerrigan
1. The applicant is requesting a lot area variance for lots A and B of a division
plat as outlined in Case 81 -20 of this agenda (refer to case). As stated in
Case 81 -20, the lots as proposed will meet all other minimum standards as re-
quired by the R -1 -C.
2. Ordinance 427.23(3) states granting of a variance be reviewed on the basis of
circumstances unique to the individual property. The commission should find
the literal enforcement of provisions of the zoning ordiance would cause an
undue hardship to the property under consideration.
3,. It should also be noted that in ordinance 427.07(1) a lot of record existing
on the effective date of this ordinance (1977) would be considered a legal lot
for a single family structure provided the lot has two- thirds of the lot area
requirement for that zoning district. The R -1 -C requires 12,000 sq. ft. lot
area minimum. However, two thirds of 12,000 would equal 7920 sq. ft. Using
this as a standard, the new lots would be in excess of that minimum.
