Location: Van Buren, North of Excelsior Avenue East, running approximately
one block and ending at the Chicago, Milwaukee, St. Pal Pacific
Railroad right -of -way.
Request: Vacation of Street
STAFF FINDINGS AND COMMENTS: Kerrigan Rafferty
1. The subject right -of -way is presently used to provide access to the two adjacent
properties, Midas Muffler to the west, and a single family residential structure
to the east.
2. The applicant has stated that he is presently in ownership of the lots directly
to the west. The application for vacation is being requested in order to facilitate
the applicants development of a number of vacant lots to the west including the lots
directly contiguous to the subject roadway. He has stated that the street if vacate
would be used for parking for the proposed development.
M 3. The existing street contains public utilities and thus an easement should be receive
if the vacation is approved. Also, prior to an approval a plan should be submitted
which details proposed access to the adjacent parcels.
4. The applicant has stated that he has informed the property owner to the west of the
proposed vacation and that he finds such action acceptable. The various utility
companies have also been notified and find no problem with the vacation as long as
an easement is received.
