Proposed Action.
Staff recommends adoption of the following motion: Move that Council adopt Resolution 2006-
069. Resolution for Adoption of Assessment Roll. 2006 Miscellaneous Special Assessments.
Overview.
The proposed special assessments as described in Exhibit A are for delinquent utility bills,
citations, and invoices. Notices of this hearing have been published, and both notices and
assessment statements have been mailed to all affected property owners.

Primary Issues to Consider.
. Assessment items
Refer to attached Exhibit A. Property owners who have paid their proposed assessment
between the time of notification and the Assessment Hearing date have been deleted from
the assessment roll.
Appeal process
If residents have not waived their rights to appeal, they are given the opportunity to
approach Council during the public hearing. Standard appeal forms have been available
at City Hall and need to be submitted no later than the public assessment hearing date.
Should there be appeals presented to Council during the public hearing, Council may
continue the hearing to the October 24, 2006 Council work session to allow staff time to
examine the appeals and make a recommendation. This would still meet the statutory
requirement of allowing the 30-day interest free period for payments prior to certification
on November 30, 2006.
Owner appeals/staff recommendations
To date, our office has received one appeal.
1. P.I.D. #23-117-2241 0051, 129 19th Avenue N - Appeal is for cancellation of the
assessment on four delinquent citations totaling $800.00 ($600.00 for the citation
fines and $200.00 in service charges) for failure to remove junk vehicles and failure
to remove open storage. The property owner states in their appeal that they were
unaware of the citations because they were not sent to their home in Minnetonka.
Staff recommends that the assessment amount be reduced to $175.00 to cover the cost
of many hours of staff time spent on this property. See the attached memorandum
from Elizaeth Page, Housing Inspector.

NOTICE OF ASSESSMENT HEARING
NOTICE IS HEREBY GIVEN that the City Council of Hopkins, Minnesota, will meet in
the Council Chambers of the Hopkins City Hall, 1010 1 st Street South, Hopkins, Minnesota at
7:30 p.m. on Tuesday, October 17,2006, to pass upon the proposed special assessments for the
costs of delinquent utility bills, for delinquent invoices, and for delinquent citations. Please see
the enclosed Statement of Assessment for your property.
Except for petitioners who have waived their right to notice or objection, all persons who
wish to be heard, or to object with reference to this matter may present their cases at this hearing
either orally or in writing. No appeal may be taken as to the amount of any assessment adopted
unless a written objection signed by the property owner is filed with the Special Assessment
Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Even
though appeals are due by the hearing date on October 17, 2006, the City Clerk strongly
recommends that appeals be submitted to the Special Assessment Clerk's office by October 13,
2006. Appeal forms will be available at the assessment hearing or at the Special Assessment
Clerk's office at the Hopkins City Hall, 1010 1 st Street South, Hopkins, Minnesota.
An owner may appeal an assessment to district court pursuant to MSA Section 429.081
by serving notice of the appeal upon the Mayor or City Clerk of the City of Hopkins within thirty
(30) days after the adoption of the assessment and by filing such notice with the district court
within ten (10) days after service upon the Mayor and City Clerk.
Under provisions of Minnesota Statutes Section 435.193 to 435.195 the City may, at its
discretion, defer the payment of assessments for any homestead property owned by a person 65
years of age or older for whom it would be a hardship to make the payments. The procedures to
apply for such deferment are available from the Special Assessment Clerk. Deferment
applications should be submitted to the Special Assessment Clerk by October 13,2006.
The following information shall also apply:
1. The property owner shall have the right to prepay the entire assessment. Your
assessment may be paid without interest from October 17. 2006 to November 16. 2006. to the
Special Assessment Clerk at City Hall, 1010 1st Street South, Hopkins, Minnesota. You may at
any time thereafter and prior to November 30, 2006 pay to the Special Assessment Clerk the
entire amount of the assessment remaining unpaid, with interest accrued from October 17, 2006
to the date in which such payment is made. Such payment must be made prior to November 30,
2006 or interest will be charged through December 31 of the succeeding year.
2. Partial prepayment of the assessment in excess of 25 percent of the total
assessment has been authorized by ordinance. A partial prepayment can only be made prior to
November 30,2006 with interest accrued to the payment date, except that no interest shall be
charged on said partial payment if such partial payment is made by November 16, 2006.
3. In the case where accrued interest applies, the rate of interest to be accrued, if the
assessment is not prepaid within the required time period, is proposed to be 7 percent
commencing on the date of adoption by the City Council. Assessments shall be payable in one
annual installment.
4. The amount to be specially assessed against your property is shown on the
enclosed Statement of Assessment.
5. A $50.00 service charge has been added to the amount to be assessed for all
delinquent bills.
This is an important hearing because this is your last opportunity to be heard on the
matter of this assessment, which affects your property. If you have any questions regarding this
assessment, please call the Special Assessment Clerk at 952-548-6310.

To Whom It May Concern:
On September 29th, we received, at our home at 4632 Gaywood Drive, Minnetonka, a
Citation #05-40, 05-42, 05-46, 05-55 for property owned in Hopkins identified above.
As per our rights, we wish to appeal in writing the TOTAL ASSESSMENT charge of
$800.00. Due to work commitment, I am unable to appear in person to appeal the
charges.
The reason for the appeal follows:
My husband George and I purchased the property in Hopkins over 12 years ago to help
our son, Greg, a single father of two daughters, raise our grandchildren in a neighborhood
that would offer them consistency and continuity in their lives. The oldest child is now a
freshman at the University ofMN Morris. It is expected that his second daughter will
follow in her footsteps and pursue a college education in a few years. It is important to us
that our granddaughters are able to move out of a poverty situation and do the best they
can to become productive citizens,
George and I realize that the property is in disrepair and are doing what we can to remedy
the situation. It is important that the Court understand the first time we became aware of
the citation charges was on June 20, 2006. A letter was sent to our Minnetonka address
from Ms. Elizabeth Page explaining that she had just become aware that the property was
in our name, through communication with the Hennepin County Taxation Office. She
now understood that we were unaware of said citations because they had never been sent
to our attention at our home in Minnetonka.
Recognizing the seriousness of the charges, I called Ms. Page and offered our full
cooperation to rectify the situation. We had a very agreeable conversation. She
understood that we would need some time to meet the required updates and granted us an
extension, with a final inspection on or after August 2, 2006.

Subsequent to conversation, we completed the following tasks:
1) Removed large boat that was temporarily stored on property, and that belonged to
a friend of our son
2) Purchased license tabs for three vehicles to bring them up to code
3) Purchased permit to re-roofthe garage
Note: a key citation stated: Scrape and paint chipping and peeling paint on
exterior of garage and remove rotten wood It was clear to us that the garage roof
and trim needed more than a simple scraping and painting. The entire roof
required extensive repair work. My son Greg has spent many hours fixing the roof
boards, removing and replacing rotten wood and will have completed the
roofing/shingles process by early October. We will also paint the entire garage
and its trim before mid - October.
4) Summer wind damage blew down several trees in the property backyard. A fire
pit has been built and will serve to burn the wood refuse created by the storm. Old
wooden doors will be cut and burned as well.
On August 28th. Ms. Page and I spoke by phone and she agreed to allow us additional
time to complete the roofmg and remaining yard clean up. I explained at that time that
we are re-roofing the garage because cosmetic change would not be enough. The
extension date was granted to Monday, October 16,2006.
I hope you can see that we are working hard to do everything we can to bring the
property up to minimum city ordinance standards. We trust that we will be treated fairly
in our request to remove the Assessment charge of $800.00 because of the recent notice
to us of property failings, and our attempt to clear all citation orders as requested.

Appeal of Assessments for 129-19th Ave. N
RE:
In response to the appeal from the owner of 129-19th Ave. N, Annette Wagener, to waive the
assessment of $800.00 I recommend the following:
1. Reduce the assessment amount to $175.00. This would be the cost of 5 re-
inspections. Waive the assessment fee of $50.00 or give the owner the
opportunity to pay it without the additional fee.
OR
2. Reduce the assessment fee to $125.00 plus the cost of the $50.00 assessment fee.
Totaling $175.00.
Reasons:
The owner's son, Greg Wagener, occupies the property at 129-19th Ave. N and signed for the
certified mail for all of the administrative citations. He obviously did not communicate with his
parents, the property owners about the letters with the correction orders or the administrative
citations (fines). Since Annette Wa~ner has been contacted at their Minnetonka address she has
cooperated and gotten the property in compliance with some of the codes that were in violation
and is actively working towards compliance with the remaining two violations.
I am recommending we charge $175.00 because there have been many hours of staff time spent
on this property; there have been over 12 inspections conducted of this property, letters,
administrative citations, and it was in the process of being sent to District Court before the
Minnetonka address was brought to my attention.

INFORMATION ON SPECIAL ASSESSMENTS
HOW ARE SPECIAL ASSESSMENTS PAID?
1. If the assessment is not paid orior to November 30,2006, it will automatically be included
with the real estate taxes payable beginning in 2007. The actual terms of financing are set by
the City Council at the Public Hearing. The interest rate is proposed to be 7%.
2. The assessment can be paid off in full or in part (at least 25%). The procedure and deadline
for payments will be as follows:
October 17" 2006 to November 16" 2006 (assumin!! adoution on October 17" 2006) - 30
day interest free.
During this period, the owner may pay all or part of the total, interest free.
Partial payments must be at least 25% of the assessment.
November 17" 2006 to November 29" 2006 - interest accrues from date of adoution on
any uayment made durin!! this time.
After the 30-day period, the total may be paid with interest prorated from
the date of adoption, October 17, 2006, to the date of payment, until
November 29, 2006.
Partial payments of at least 25% are still accepted, although interest charges
will apply to the payment.
November 30" 2006 - assessments are certified to Henneuin County.
Payments can no longer be accepted by the City of Hopkins.
On November 30, 2006, the assessments are certified to Hennepin County
for collection with the property taxes payable beginning in 2007 for a term
one year.
15 months of interest is added to the assessments certified to the property
taxes payable in 2007.
NOTE: Pursuant to State Statutes, the City is required to follow the procedure and deadlines
listed above.
SPECIAL ASSESSMENT DEFERMENTS
The City Council may in its discretion defer payment of special assessments upon request. The property
must be homesteaded by the property owner. Also the property owner must be 65 years of age or older
or retired by virtue of a permanent and total disability. The income is not to exceed $31,068 as of
January 1, 2006. Income verification is required. Application for deferment must be made no later than
the hearing date.
WHERE MAY ADDITIONAL INFORMATION CONCERNING SPECIAL ASSESSMENTS BE

ADOPTION OF THE ASSESSMENT ROLL
2006 MISCELLANEOUS SPECIAL ASSESSMENTS
WHEREAS, pursuant to proper notice duly given as required by law, the City Council
has met and heard and passed upon all objections to the proposed assessment for delinquent
utility bills, citations, and delinquent invoices, all as more fully set forth and described in Exhibit
A as attached to this resolution, and has amended such proposed assessment as it deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS,
MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is
hereby accepted and shall constitute the special assessment against the lands named therein, and
each tract of land therein included is hereby found to be benefited by the proposed improvement
in the amount of the assessment levied against it.
2. Such assessments shall be payable in equal, annual installments extending over the
periods of years set forth in Exhibit A, the first of the installments to be payable on or after the
first Monday in January of 2007. Any deferred installments shall bear interest at the rate set
forth in said Exhibit A from the date of the adoption of this assessment resolution. To the first
installment shall be added interest on the entire assessment from October 17, 2006, until
December 31, 2007. To each subsequent installment when due shall be added interest for one
year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole or a partial payment of at least 25% of the
assessment on such property, with interest accrued to the date of payment, to the city treasurer,
except that no interest shall be charged if the entire assessment is paid within 30 days from the
adoption of this resolution; and he may, at any time thereafter, pay to the city treasurer the entire
amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in
which such payment is made. Such payment must be made prior to November 15 or interest will
be charged through December 31 of the next succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be
collected and paid over in the same manner as other municipal taxes.

5. It is hereby declared to be the intention of the Council to reimburse itself in the future for
the portion of the cost of this improvement paid for from municipal funds by levying additional
assessments, on notice and hearing as provided for the assessments herein made, upon any
properties abutting on the improvement but not made, upon any properties abutting on the
improvement but not herein assessed for the improvement, when changed conditions relating to
such properties make such assessment feasible.
6. To the extent that this improvement benefits nonabutting properties which may be served
by the improvement when one or more later extensions or improvements are made, but which are
not herein assessed, therefore, it is hereby declared to be the intention of the Council, as
authorized by Minnesota Statutes Section 420.051, to reimburse the City by adding any portion
of the cost so paid to the assessments levied for any of such later extension or improvements.
7. The clerk shall forthwith transmit a certified duplicate of this assessment to the County
Auditor to be extended on the property tax lists of the County, and such assessments shall be
collected and paid over in the same manner as other municipal taxes.
