Proposed Action.
Staff recommends the following motion: "Move that Council adopt Resolution 2006-077. Resolution
Orderina Public Improvement Hearina. 2007 Street and Utilitv Improvements. City Proiect 06-10.
This action continues an assessable project for street upgrading.
Overview.
At its September 5, 2006 meeting, the Hopkins City Council authorized Bolten and Menk Inc. to
prepare a feasibility study concerning street improvements on 19th Avenue North between 2nd and 4th
Streets North; 3rd Street North between 18th and 19th Avenues North; Drillane neighborhood and
portions of 12th to 16th Avenues North. The report is complete and is now submitted to Council for
review and further action. A summary of issues is provided here, but staff will provide a detailed
summary of the report at the scheduled Council meeting.

Scope of Improvements
Proposed street improvements include complete reconstruction of the Drillane neighborhood and 19th
Avenue North and 3rd Street North with asphalt pavement, concrete curb and gutter.
Proposed water main upgrades are limited to the voluntary water service replacement program that was
instituted in last year's street improvement project and hydrant replacement. Last year's project shared
the cost of replacing water service from the water main to the right of way line between the resident and
City. The City would pay 1/3 of the pipe and installation costs.
Proposed sanitary sewer improvements include minor reconstruction of manhole tops to match street
grades and main line spot repairs on 19th Avenue North and complete reconstruction of the sanitary sewer
in the Drillane neighborhood. The replacement is necessary due to the condition of the existing sewer
mains.
Proposed storm sewer upgrades include extension of storm sewer from the intersection of 19th Avenue
and 1st Street to the intersection of 19th Avenue and 3rd Street to remove a significant drainage problem.
Storm sewer will also be needed in the Drillane neighborhood in conjunction with the installation of curb
and gutter.
A mill and overlay is proposed for 1 ih to 16th Avenues north of Mainstreet. With curb installation along
Metzold Field.
Public Input
A public information meeting was held on November 14, 2006, and a resident survey questionnaire was
sent in the mail. Responses and feedback gathered through the returned questionnaires have generally
been for the project due to the conditions of the streets.
On Tuesday, November 14, 2006, we held a public information meeting to discuss the 2007 Street and
Utility Improvement project. The meeting was divided into three sessions encompassing each
improvement area. A summary of each session follows.
6:00 Overlay Area
There were about 10 people in attendance for this session. We described the mill and overlay process,
project schedule and funding. We stressed that this was not an assessment project. We also stressed
that the scope of the project may change with budget constraints.
The residents were generally pleased with the project and voice no objections. One resident wanted curb
installed with the project. We explained that this would be assessable and not within the scope of a
maintenance project.
6:30 19th Avenue and 3rd Street Reconstruction
We had approximately 15 people at this session. We explained the scope of the project including
substantial storm sewer improvements. We discussed assessments and schedule.

Residents were generally pleased with the project and wished it could be expanded. One resident wants
us to look at the 19th Ave and 4th St intersection for safety improvements.
7:30 Drillane Reconstruction
There were about 8 residents at this session. We presented the scope of the improvements, assessments
and schedule.
There was general agreement that the street needs to be re-built and that curb and gutter is desirable.
The most controversial aspect was the sanitary sewer portion of the project. As we examined this project,
we found a large amount of Inflow/Infiltration into the sanitary sewer station. As you are aware, the Met
Council is now penalizing the City for excess water in the sanitary system. ($89,000 for 2007) Through our
feasibility investigations, we found 6 homes that may have illegal clear water connections to the sanitary
sewer (e.g. footing drains and sump pumps). We also found the sewer main to be in very bad shape and
in need of replacement.
The controversy is that the residents with illegal connections must disconnect them. Also, there was
concern that sealing the leaks in the sewer main will cause the ground water to rise and flood basements.
This is a possible but unlikely consequence. Additionally, the sewer is not the appropriate way to provide
drain tiling. One resident said he felt the City was replacing the road just to fix the sewer problem and
save $89,000 at the expense of the residents. We told them how the street was selected for
reconstruction because of its condition and then we discovered the extent of the III problem during our
study. We further explained that we would require the removal of illegal connections regardless of whether
or not the project moved forward.
One idea to help the residents with the installation of sump pumps would be to make those costs eligible
for inclusion with their assessments. It would be a resident cost, but not all at once.
The meeting broke up at approximately 9:00.
The input received from the meeting and the questionnaires will continue to be used and addressed
throughout the final design process should the project be approved.
Costs and Assessments
The total estimated project cost is $2,345,839. This includes a 10% contingency and engineering/
administration costs at 25%. Of this amount, approximately $418,681 is subject to the special assessment
process based on the staff recommendation to implement a cap assessment rate of $66.15 per foot and
$7,885.85 per unit. A detail of costs is included in Appendix A the feasibility report.
The City's standard assessment policy provides for abutting property owners to be assessed 70% of actual
street reconstruction costs. The cap is based on 120% of the average of the three previous similar
projects. The per unit cap is based on the $66.15 per foot cap multiplied by the total front footage in the
Drillane neighborhood divided by the number of lots.
The unit assessment is proposed I the Drillane neighborhood because of the irregularly shaped lots and
equal benefit received by each lot.

This leaves a funding gap of approximately $547,000. The primary reason for the high cost is that the price of
asphalt has risen approximately 40% since last year.
We have a number of strategies for dealing with this issue. First, we proposed delaying construction of the
storm sewer on 19th Avenue from 18t Street to 2nd Street until the 2009 construction project that includes that
segment of 19th Avenue. This will save approximately $100,000 on this year's project. Secondly, we propose
to delay the mill and overlay segments on 14th to 16th Avenues North until 2009 as well. This will save
approximately $450,000 in total project costs and bring us back under budget.

RESOLUTION ORDERING PUBLIC IMPROVEMENT HEARING
2007 STREET AND UTILITY IMPROVEMENTS
CITY PROJECT 06-10
WHEREAS, the City Council authorized and directed the City Engineer to
prepare a report with reference to the aforesaid improvement, and
WHEREAS, the City Engineer has caused to be prepared the aforesaid report for
improvements on Drillane Road North and South, Drillane Circle, 19th Avenue North
from 2nd Street North to 4th Street North, and 3rd Street North between 18th and 19th
Avenues North,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Hopkins, Minnesota:
1. The Council will consider the improvement of such street in accordance
with the report and the assessment of abutting property for all or a portion
of the cost of the improvement pursuant to Minnesota Statutes Chapter
429 at an estimated total cost of $2,345,839.00.
2. A public hearing shall be held on such proposed improvement on
Tuesday, the 19th day of December, 2006 in the Council Chambers of the
City Hall at 1010 First Street South at 7:30 P.M and the City Clerk shall
give mailed and published notice of said hearing and improvements as
required by law.
