CONDITIONAL USE PERMIT - BLOCK 64
ProDosed Action.
Staff recommends the following motion: Move to adopt Resolution 06-85. approving a
conditional use permit to allow residential in a B-3 zoning district for the Sixth and Main
Development.
At the Zoning and Planning meeting Mr. Hatlestad moved and Mr. Aarness seconded a
motion to adopt Resolution RZ06-37, recommending approval of a conditional use permit to
allow residential in a B-3 zoning district for the Sixth and Main Development. The motion
was approved unanimously.
Overview.
GPS Financial Properties is proposing to redevelop the block north of Mainstreet and south
of First Street North between Fifth and Sixth Avenues. The entire block will be razed to
construct six buildings with 220 units. There will also be approximately 8,800 square feet of
retail along Mainstreet. It is proposed there will be four buildings of 35 units, plus a guest
unit, and two buildings of 36 units. The residential buildings will be four stories.
The condominiums will be owner-occupied. The units will be loft-style with open floor plans
and nine to ten-foot ceilings. The units will range in size from 899 square feet to 1460
square feet. There will be a community room on the second floor for the residents.
The applicant has also applied for the following actions:

Primarv Issues to Consider.
What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The zoning of the property along Mainstreet is B-3, General Business. The Comprehensive
Plan has designated this Commercial. Residential uses are permitted in the business district
above retail.
What are the conditions for residential in a business district?
The following are the conditions for residential uses in the B-3 district:
Dwelling units not occupying first floor shall have:
1. one off-street parking space for each unit;
2. an entrance leading directly to a public street;
3. the density allowed shall be R-3.
The density of the development will be greater than the R-3. The applicant has applied for a
rezoning to PUD, which allows flexibility in the zoning requirements. The proposed plan
meets the other requirements for residential in the B-3 zoning district.
What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the conditional use permit. Charlotte Flanagan of GPS Development
LLC, appeared before the Commission. Mr. Aarness expressed concern that an individual
cou1c buy several units and rent them. "Mr. Aarness suggested that an additional condition be
added that no more than 15 percent could be rented. The Commission discussed this issue
and recommended that an additional condition be added that no more than 10 percent of the
units can be rented. No one else appeared at the meeting regarding this item.
Alternatives.
1. Approve a conditional use permit to allow residential units in the B-3 zoning district. By
approving the conditional use permit, the applicant will not be able to construct the
development as proposed.
2. Deny a conditional use permit to allow residential units in the B-3 zoning district. By
denying the conditional use permit, the applicant will not be able to construct the
development as proposed. If the City Council considers this alternative, findings will
have to be identified that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A CONDITIONAL USE PERMIT TO CONSTRUCT A RETAIL AND
RESIDENTIAL DEVELOPMENT
WHEREAS, an application for Conditional Use Permit CUP06-7 has been made by GPS
Development, LLC; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for a conditional use permit was made by GPS
Development, LLC;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on November 28, 2006: all persons present were given an
opportunity to be heard;
3. That the written comments and analysis of City staff were considered; and
4. A legal description of the subject property is as follows:
Lot 1, Block 1, Sixth and Main
NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit
CUP06-7 is hereby approved based on the following Findings of Fact:
1. That the proposed use meets the requirements for a conditional use permit.
BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP06-7 is hereby
approved subject to the following conditions:
1. A park dedication fee is required for each unit.
2. The Public Works Department reserves the right to continue reviewing any plans submitted for
approval and to place new or revised conditions on construction as may be required. All
future plan sets must be signed and submitted with revision dates.
3. That the subject property is overlaid with a PUD zoning.
4. That the site plan is approved.
5. That the preliminary/final plat is approved.
6. That no more than 10 percent of the units are rental units.
