PRELIMINARY PLAT - BLOCK 64
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 06-84. approvIng a
preliminary plat for the Sixth and Main Development.
At the Zoning and Planning meeting Ms. Flynn moved and Ms. Newcomb seconded a motion
to adopt Resolution RZ06-36, recommending approval of a preliminary/final plat for the
Sixth and Main Development. The motion was approved unanimously.
Overview.
GPS Financial Properties is proposing to redevelop the block north of Mainstreet and south
of First Street North between Fifth and Sixth Avenues. The entire block will be razed to
construct six buildings with 220 units. There will also be approximately 6,800 square feet of
retail along Mainstreet. It is proposed there will be four buildings of 35 units plus a guest
unit and two buildings of 36 units. The residential buildings will be four stories.
The existing property has several lots on this block. The new plat will replat only phase I of
the proposed development, the remaining property will not be replatted until that phase starts.

Primary Issues to Consider.
What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The zoning of the property is B-3 and R-4" The Comprehensive Plan has designated the site
as business and high density residential. The proposed use complies with both documents.
The site will have an overlay zoning of Planned Unit Development to allow flexibility with
the design of the buildings.
Does the lot meet the minimum lot requirements?
The minimum lot size is 20,000 square feet in the R-4 zoning district and 3,000 square feet in
the B-3 zoning district. The new lot will be 66,433 square feet.
What are the specifics of the plat?
The first phase will be repatted into one lot. The remaining block will remain the same and
replatted at the time the site plan is approved.
. Does the proposed plat meet the subdivision requirements?
The proposed subdivision meets the subdivision requirements.
Will a park dedication fee be required?
A park dedication fee will be required. The fee is $800 per residential use and five percent
of the commercial value for the commercial area.
What was the discussion at the Zoning and Planning meeting?
Ms. Anderson stated that the entire block would be one lot. Charlotte Flanagan of GPS
Development, LLC, appeared before the Commission. Noone else appeared at the meeting
regarding this item.
Alternatives.
1. Approve the preliminary plat. By approving the preliminary plat, the applicant will be
able file for a final plat to construct the development as proposed.
2. Deny the preliminary plat. By denying the preliminary plat, the applicant will not be able
file for a final plat to construct the development as proposed. If the City Council
considers this alternative, findings will have to be identified that support this alternative.

3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A PRELIMINARY PLAT FOR THE SIXTH AND MAIN DEVELOPMENT
WHEREAS, an application for a preliminary plat SUBD06-2 has been made by GPS Development,
LLC; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for a preliminary plat was made by GPS Development, LLC;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published
notice, held a public hearing on the application and reviewed such application on
November 28,2006: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered; and
NOW, THEREFORE, BE IT RESOLVED that the application for a preliminary plat SUBD06-2
is hereby approved based on the following Findings of Fact:
1. That the preliminary plat meets the subdivision requirements.
2. That the preliminary plat meets the zoning requirements.
BE IT FURTHER RESOLVED that application for preliminary plat SUBD06-2 is hereby
approved based on the following conditions:
1. That the site plan is approved for the first phase.
2. That the conditional use permit is approved to allow residential in the B-3 zoning district.
3. That the overlay zoning to Planned Unit Development is approved.
4. That the applicant shall acquire fee title to all of the land included within the PUD district
and provide the City attorney with evidence of title acceptable to the city attorney
demonstrating the applicant holds fee title to that land when the final plat is approved.
