Inc. for oroiect enaineerina services. This action continues an assessable project for street improvements. Overview. At the September 5, 2006 meeting the Hopkins City Council authorized Bolton and Menk, Inc. to prepare a feasibility report concerning street improvements on 19th Avenue North between 2nd and 4th Streets North; 3rd Street North between 18th and 19th Avenues North; Drillane neighborhood and portions of 12th to 16th Avenues North. The report was presented to City Council at its November 21,2006 meeting and a public hearing was ordered for December 19, 2006. Hearing notices have been mailed to all affected property owners of record. In accordance with state statutes, City Council needs to conduct the public hearing and determine authorization of the project. Following the public hearing, if the project is ordered City Council is asked to authorize the engineering services for the project and to state the City's intent to sell revenue bonds to fund the project. MSA: $150.000 Council Report 2006-151 Page 2 Analvsis of Issu s · Scope of Improvements Proposed street improvements include complete reconstruction of the Orillane neighborhood and 19th Avenue North and 3rd Street North with asphalt pavement, concrete curb and gutter. Proposed water main upgrades are limited to the voluntary water service replacement program that was instituted in last year's street improvement project and hydrant replacement. Last year's project shared the cost of replacing water service from the water main to the right of way line between the resident and City. The City would pay 1/3 of the pipe and installation costs. Proposed sanitary sewer improvements include minor reconstruction of manhole tops to match street grades and main line spot repairs on 19th Avenue North and complete reconstruction of the sanitary sewer in the Orillane neighborhood. The replacement is necessary due to the condition of the existing sewer mains. Proposed storm sewer upgrades include extension of storm sewer from the intersection of 19th Avenue and 1 st Street to the intersection of 19th Avenue and 3rd Street to remove a significant drainage problem. Storm sewer will also be needed in the Orillane neighborhood in conjunction with the installation of curb and gutter. A mill and overlay is proposed for 12th and 13th Avenues north of Mainstreet due to their condition; and on 19th Avenue North from 1st to 2nd Streets because of the storm sewer construction in the area. The scope has been pared down in conjunction with finance to fit more closely with the CIP budgets. The overlays originally proposed for 14, 15th and 16th Avenues North have been eliminated from the project and will likely be completed with the 2009 Street and Utility Project. Public Input A public information meeting was held on November 14, 2006, and a resident survey questionnaire was sent in the mail. Responses and feedback gathered through the returned questionnaires have generally been for the project due to the conditions of the streets. The feasibility report summarizes comments submitted. The input received from the public meeting and the questionnaire will continue to be used and addressed throughout the final design process should the project be ordered. Council Report 2006-151 Page 3 Proiect Costs The total estimated project cost after the modifications noted above is $1,950,000. These costs are split as follows: Street improvements: $1,444,000 Water Utility: $48,000 (not including city contribution towards water service replacements) Sanitary Sewer: $144,000 Storm Sewer: $314,000 Assessments The assessment rates are based on 70% of the street reconstruction costs in the project. A cap is placed on the assessments by City policy. The proposed assessments are divided into three areas: 1) 19th Avenue N. north of 2nd Street No; 2) 18th Avenues N. north of 2nd Street No; 3) Drillane Neighborhood. The assessment cap for this project is proposed to be $66.15 per front foot for 18th and 19th Avenues and at $7,885.85 per unit in the Drillane area. This rate is based on three previous similar street reconstruction projects. The Drillane neighborhood is proposed be a unit assessment because of the large, irregularly shaped lots combined with the equal benefit each property receives because of the project. The unit cap is based on the total front footage multiplied by the front foot cap and divided equally among the lots. This proposal is roughly 140/0 of a projected construction cost of $1,418,000. This rate compares favorably with previous projects, including the 2006 street improvement project. Staff Recommendation Staff recommends ordering this improvement project with adoption of Resolution 2006- 090 and adopting companion resolution 2006-091. Staff further recommends authorizing the Mayor and City Manager to enter into an agreement with Bolton and Menk, Inc. for engineering services related to this project. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Hopkins, Minnesota: 1. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report. 2. Such improvement is hereby ordered as proposed in the Council Resolution adopted the 21st day of November, 2006. The total estimated project cost is $1,950,000. 3. Bolton and Menk, Inc. is hereby designated as the engineer for this improvement. The engineer shall prepare plans and specifications for the making of such improvement. Maxwell, Mayor ATTEST: Terry Obermaier, City Clerk CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2006-091 DECLARING THE OFFICIAL INTENT OF THE CITY OF HOPKINS TO REIMBURSE CERTAIN EXPENDITURES FROM GENERAL OBLIGATION IMPROVEMENT BOND PROCEEDS TO BE ISSUED BY THE CITY OF HOPKINS WHEREAS, the Internal Revenue Service has issued Treas. Reg. #1.150-2 providing that proceeds of tax-exempt bonds used to reimburse prior expenditures shall not be deemed spent unless certain requirements are met; and WHEREAS, the City expects to incur certain expenditures, which may be financed temporarily from sources other than bonds, and reimbursed from the bond proceeds; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HOPKINS, MINNESOTA (THE CITY) AS FOLLLOWS: 1. The City intends to incur expenditures for the project described in Council Report 2006-151, for City Project 06-10 (the "Project"), and intends to reimburse itself for such expenditures from the bond proceeds to be issued by the City in the maximum principal amount described in the "project". 2. The City Manager is authorized to designate additions to Project 06-10 in circumstances where time is of the essence, and any such designation shall be reported to the Council at the earliest practicable date and shall be filed with the official books and records of the City. 3. This resolution is intended to constitute a declaration of official intent for the purpose of Treas. Reg. #1.150-2 and any successor law, regulation, ruling or amendment pertaining thereto.
