PRELIMINARY/FINAL PLAT WENDY'S
Proposed Action.
Staff recommends the following motion: Move to approve Resolution RZ95 -4 recommending
approval of a preliminary/final plat for the southeast corner of County Road 3 and 11th
Avenue.
Overview.
Wendy's is proposing to construct a restaurant on the southeast corner of County Road 3 and
1 lth Avenue. This property is currently owned by R.L. Johnson. The subject property is not
platted. In conjunction with the development of this property, the City is requiring the
applicant to plat the property. The small triangular piece of property owned by R.L. Johnson
will also be platted as an outlot.
The subject property has two existing easements. One easement is a 20 foot water easement
on the north side of the property and the second is a 10 foot NSP easement on the south side
of the property. The proposed development will not have a building on these easements.
The applicant has applied for a conditional use permit to construct the restaurant.

Primary Issues to Consider.
o Does the proposed plat meet the subdivision requirements?
The proposed plat meets the requirements of the subdivision ordinance. The staff is
recommending that the plat has a 12 foot drainage and utility easement on the east, west and
south sides.
o Does the proposed plat meet the zoning requirements?
The Zoning Ordinance requires a minimum lot size of 3000 square feet and a minimum width
of 25 feet. The subject lot is 77,195 square feet and a width 273.31 feet. The small
triangular lot will become an outlots. Outlots do not have any minimum requirements and are
unbuildable.
o Is a park dedication fee required?
In cases where no additional lots are created there is no park dedication fee required. The
shopping center on the corner of County Road 3 and Blake was platted several years ago and
was not required to have a park dedication fee.

1. Recommend approval of the preliminary/final plat. By recommending approval of the
preliminary/final plat the City Council will consider a recommendation of approval.
2. Recommend denial of the preliminary/final plat. By recommending denial of the
preliminary/final plat, the City Council will consider a recommendation of denial. If the
Commission chooses this alternative, findings of fact will have to be stated that support
this alternative.
3. Continue for further information. If the Planning Commission indicates that further
information is needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING
APPROVAL OF A PRELIMINARY/FINAL PLAT AT THE SOUTHEAST CORNER OF
11TH AVENUE AND COUNTY ROAD 3
WHEREAS, an application for a subdivision, SUBD94 -4, has been made by Wendy's for a
preliminary/final plat at the southeast corner of County Road 3 and 11th Avenue; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for a subdivision, SUBD94 -4, was filed with the City of Hopkins on
November 29, 1994.
2. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a
public hearing on the application and reviewed such application on December 27, 1994
and January 31, 1995; all persons present were given an opportunity to be heard.
3. That the written comments and analysis of the City staff and the Planning Commission
were considered.
NOW THEREFORE, BE IT RESOLVED that the application for subdivision SUBD94 -4 is
hereby recommended for approval based on the following Findings of Fact:
1. That the applicants application for a preliminary/final plat meets the requirements
of the Subdivision Ordinance:
2. That the applicants application for a preliminary/final plat meets the requirements
of the Zoning Ordinance.
BE IT FURTHER RESOLVED, that application for SUBD94 -4 is hereby recommended for
approval based on the following conditions:
1. That there is a 12 foot drainage and utility easement on the east, west and south sides of
Lot 1.
2. That the triangular lot east of the water tower is an outlot.
