Staff recommends the following motion: Move, approve Resolution RZ93 -25 recommending approval of sign variances at 1300 Mainstreet. Overview. St. Joseph Church is located at 1300 Mainstreet. The site is zoned R -5, High Density Multiple Family. Churches are a permitted use in the residential districts. During the Mainstreet project the existing identification sign of the church was removed. Currently the church only has a sign on the building for identification. St. Joseph Church is proposing to erect two 4'x 6' signs on the site, one in front of the church and a second in front of the school. Both signs will have a one foot front yard setback. The sign for the church will advertise the denomination, schedules and phone number. The sign ill for the school will identify the school. Primary Issues to Consider. o What are the zoning requirements for a sign in the R-5 zoning district? o What are the specifics of the proposed sign? o Why is the applicant requesting the variance? o Does the applicants property have a hardship? The Zoning Ordinance allows a maximum size sign of 12 square feet and a front yard setback of 30 feet in the R -5 zoning district. o What are the specifics of the proposed signs? The sign at the church will be 4' x 6' (24 square feet) double sided sign for a total of 48 square feet. The school sign will be 4' x 6' (24 square feet) and only one side. The applicant is proposing a one foot setback for both signs. o Why is the applicant requesting the variance? The applicant has stated that the church is requesting the variance because the allowed signage would not be effective. The zoning to the east and west of the site is zoned B -3. In a B -3 zoning district a business is allowed a maximum sign of 80 square feet and a 1 foot setback. Because of the commercial zoning in the abutting areas to the east and west, the applicant is requesting a variance for the same requirements as the B -3 zoning. o Does the applicants property have a hardship? There is not sufficient room for the applicant to put a sign in the front yard setback and meet the required setback. The church is 26 feet from the property line at the furthermost point. A sign could be placed on either side of the church at the required setback, but would not be very effective or visible from the street. Also, a twelve square foot sign would not be proportional to the size of the church. Due to the activities, traffic, etc. which is occurring on the site, the church is basically serving as a commercial use, located in a commercial area, but because of the residential zoning is required to meet the sign requirements for a residential district. Because the majority of the buildings surrounding the applicants property are on Mainstreet or a few feet from Mainstreet and because the church and school are setback further than the other Mainstreet buildings, the visibility to the applicants property with a 30 foot setback for a sign is very limited. A sign could be placed with a 30 foot setback in front of the school, but the sign would be so close to the school, the visibility from Mainstreet would be very limited. Also, the building to the west of the school has approximately a 10 foot front yard setback. If the sign was setback 30 feet, a car going east bound would not see the sign until it was in front of the school. A sign variance was granted to Zion Lutheran Church several years ago, for size and setback. 1 VN 93 -7 Page 3 Alternatives. 1. Recommend approval the of variance. By recommending the City Council will consider a recommendation of approval of the proposed signs. 2. Recommend denial of the variance. By recommending denial of the variance the City Council will consider a recommendation of denial. If this alternative is recommended, the Planning Commission will have to state findings of fact which supports this decision. 3. Continue for further information. WHEREAS, the procedural history of the application is as follows: 1. That an application for a variance VN93 -7 was filed with the City of Hopkins on October 11, 1993. 2. That the Hopkins Planning Commission, pursuant to mailed notices, held a meeting on the application and reviewed such application on November 30, 1993: all persons present were given an opportunity to be heard. 3. That the written comments and analysis of the City staff and the Planning Commission were considered. NOW THEREFORE, BE IT RESOLVED that the application for variance VN93 -7 is hereby recommended for approval based on the following Findings of Fact: 1. That the subject property has an undue hardship because of the way the buildings are situated on the site. 2. That the subject property is unique because it is surrounded by buildings that restrict the visibility of the applicant's property. Adopted this 30th day of November, 1993. Patricia M.
