Proposed Action.
Staff recommends approval of the following motion: "Move approval of
Resolution No: Z89 -2 request to construct five townhouses within a
PUD ".
Approval of this motion will allow construction of five townhomes.
Overview.
The applicant is proposing to extend the West Oaks Townhomes into
Hopkins. Currently all the townhomes are in Minnetonka. When this
development was first approved, the Hopkins land was to be used as a
holding pond for water.
Since this project was approved by Minnetonka, the applicant has made
changes in the drainage so the Hopkins land is no longer needed
totally for a holding pond. We have talked to the Minnetonka staff
about this site and they have no objection to the construction of the
townhomes. Most of the west end of the site will remain as a holding
pond for water.
Staff is recommending approval because the project conforms to the
ordinance and will also provide a quality development in Hopkins.

Detailed Background.
Site Characteristics
The existing site is vacant land which is surrounded by homes to the
south, north, west, and Oakridge Golf Course to the east. The west
part of the site is lower than the east and is and will continue to be
used as a water holding pond. The walking path to the south will
remain.
Access
Access to the site will be from County Road #73. The applicant will
have to receive permission from the County for this access. The
internal road will also continue north into the Minnetonka Townhomes.
Grading /Drainage
The Director of Engineering has reviewed the grading /drainage plan and
found them acceptable. Drainage will flow toward the west.
The applicant has talked with the Minnehaha Watershed District but has
not yet received approval. Any approval should be contingent on
watershed approval.
Utilities
The utility plan has been reviewed by the Director of Engineering. He
has recommended that, if possible, all utilities be supplied by
Hopkins. The proposed plan shows sanitary sewer from Minnetonka.
Service is available from Hopkins on County Road #73. The applicant
will see if it is possible to get the sanitary sewer from Hopkins.
Current Zoning /Guide Plan
The current zoning is R -3. The R -3 district allows townhomes.
The current guide plan designates this site as R -4 and the new guide
plan as medium density multiple family. Both of these plans are
consistent with the proposed plan.
Fire Marshal
The Fire Marshal has reviewed the plans and found them acceptable.
Landscaping
The site is required to have five trees. The landscaping plan
reflects landscaping throughout the site. The walking path will be
separated from the townhomes by a green area with trees. Trees will
surround the holding pond. The proposed landscaping is consistent
with the landscaping of the Minnetonka townhomes.
Exterior Materials
The exterior materials will be the same as the townhomes in
Minnetonka. The siding is brown in color and the trim is white. The
townhomes will also have cedar shingles.
Primary Issues to Consider.
o Will the development affect drainage on the surrounding area?
When the West Oaks development was proposed, the Hopkins site was to
be used as a holding pond for water. During construction other things
were done so the Hopkins site was not totally needed for a holding
area. The proposed development will still allow for a holding pond on
the west side of the site.

The Minnetonka staff has no objection to the Hopkins site being
developed.
o Will the development have an affect on the surrounding area?
The proposed development should not affect any of the surrounding
area. The traffic from the townhomes will be minimal and will not
have access to the residential area to the south. If there were to be
an impact on an area, it would be the residential area to the south.
This area will be separated from this development by a great deal of
landscaping.
The density of the development is so minimal and the development
really is self contained that there should be no affect to any of the
surrounding areas.

RESOLUTION NO: Z89 -2
RESOLUTION MAKING FINDINGS OF FACT, AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP89 -5
WHEREAS, an application for a Conditional Use Permit
entitled CUP89 -5 made by The Pemtom Company,
to construct five townhomes on the east side of
County Road 73 just north of Robinwood Lane is
approved.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for Conditional Use
Permit CUP89 -5 was filed with the City of
Hopkins on May 8, 1989.
2. That the Hopkins Planning Commission reviewed
such application on May 30, 1989.
3. That the Hopkins Planning Commission,
pursuant to published and mailed notices,
held a public hearing on May 30, 1989: all
persons present at the hearing were given an
opportunity to be heard.
4. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for
Conditional Use Permit CUP89 -5 is hereby approved
subject to the following Findings of Fact:
1. That townhomes are a permitted use within an
R -3 District.
2. That the proposed townhomes meet the "
requirement for an R -3 District.
BE IT FURTHER RESOLVED, that application for CUP 89 -5 is
hereby recommended for approval subject to the
following Conditions:
1. That the preliminary plat is approved.
2. That Hennepin County approves the access point
into the site.
3. That all utilities are obtained from Hopkins if
possible.
4. That the walking path on the south side of the
property remains.
5. That the Minnehaha Watershed District approves the
proposed development.
