BANNERS /TEMPORARY CIVIC SIGNS
Proposed Action.
Staff recommends approval of the following motion: "Move that the
Zoning Ordinance be amended to make temporary civic signs, such as
banners and pennants that promote civic events, a legal use on
Mainstreet in the B -2 district ".
Approval of this motion will limit the type and quantity of signs
across the right -of -way in the permitted area
Overview.
The City currently allows the placement of banners across Mainstreet
by precedent. However, the existing Zoning Ordinance does not address
signs across the City right -of -way. The current language is
inadequate because the City has no means to control signs from
crossing the right -of -way.
In the staffs' opinion, there may be potential problems with signs
over City rights -of -way. Some of these problems include too many
signs across the right -of -way or signs too low, causing obstructions
to emergency vehicles or trucks. Staff feels that signs that cross
the right -of- way should be regulated to prevent problems in the
future.
The proposed language will limit signs across the right -of -way to
civic signs only, require a sign permit be secured from the Zoning
Administrator, and limit the location to the 8 2 district on
Mainstreet.

- Under what circumstances is it acceptable to place a sign across a
City right -of -way?
At this time the Zoning Ordinance does not address any type of
advertisement sign across a City right -of -way. Proposed language will
allow temporary civic signs to cross the right -of -way if the
requirements of this proposed amendment are met.
Assuming temporary civic signs are permitted over the right -of -way,
can we limit their number?
If temporary civic signs are permitted over the right -of -way, the City
Zoning Ordinance can prescribe how many may be allowed in the
permitted district. The proposed language allows no more than one
such sign per block at any given time. The permitted area is in the
B -2 district on Mainstreet. This consists of the three block area
between 8th Avenue South and llth Avenue South, meaning that no more
than three temporary civic signs could be displayed in the permitted
district at any given time.
- Are temporary signs over the right -of -way a legal use if their
purpose is to provide advertisement for profitable organizations?
A temporary permit will be issued only if the purpose of the sign is
to offer advertisement or promotion for a non- profit organization or
function. Advertising that is not for a civic or non - profit function
will not be allowed to advertise over the right -of -way.
If any commercial advertising were allowed, it would open the door for
every business in Hopkins to advertise across the City right - of - way.
The staff feels that the city should not provide free advertising
space for commercial use.

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
ZONING AMENDMENT TO ALLOW BANNERS /TEMPORARY CIVIC SIGNS
ON MAINSTREET IN THE B -2 DISTRICT
WHEREAS, an amendment to allow Banners /Temporary Civic Signs
on Mainstreet in the B -2 District is approved.
WHEREAS, the procedural history of the application is as
follows:
1. That an amendment to allow Banners /Temporary
Civic Signs on Mainstreet in the B -2 District
was initiated by the City of Hopkins.
2. That the Hopkins Planning Commission reviewed
such amendment on May 30, 1989.
3. That the Hopkins Planning Commission,
pursuant to published notice, held a public
hearing on May 30, 1989: all persons present
at the hearing were given an opportunity to
be heard.
4. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that an amendment to allow
banners /temporary civic signs on Mainstreet in the
B -2 District is approved with the following
Findings of Fact:
1. That temporary civic signs across the right-
of-way should be controlled to prevent sign
pollution.
2. The height of temporary civic signs should be
controlled to prevent obstructions to
emergency vehicles.
3. That because temporary civic signs are placed
across the City right -of -way, the City has
control of these signs.

ORDINANCE NO: 515 -570 PERTAINING TO
BANNERS /TEMPORARY CIVIC SIGNS ON
MAINSTREET IN THE B-2 DISTRICT
BE IT ORDAINED by the City Council of the City of Hopkins
as follows:
That the Hopkins Zoning Ordinance No. 515 -570 be and the
same is hereby amended by adding the following provisions:

c) Permitted temporary civic signs as pursuant
to 570.24 Subd. 4.

Temporary civic signs. Temporary civic
signs are a permitted use across the right -
of -way on Mainstreet in the B -2 District
provided:
the location of the temporary civic
signs has been reviewed and approved by
the Zoning Administrator
b) the minimum height is 13 feet, 6 inches
above the crown of the street
c) a sign permit is secured
d) the approved sign is displayed no more
than 30 days in any one calendar year
e) there is allowed one such sign per
block at any given time
f) temporary civic signs are affixed to
the buildings on each side of the
right -of -way
that the sign owner receives permission
from the building owners before a
temporary civic sign can be attached.

EXISITING ORDINANCE
570.24_ Civic Signs. Subdivision 1. Civic and City groups are allowed temporary
signs for city -wide and community events. The total size for all signs shall be 250
square feet.

Subd. 2. Time Limit. Temporary signs for city -wide and community events shall
be erected no more than seven (7) days prior to the event and removed within two (2)
days following the event.
Subd_ 3. Removal_ The owner or manager of the signs, the owner of the land, or
sponsoring civic group, shall be equally responsible for the ultimate removal of the
sign_ Setback requirements may be waived for such signs provided that they are on the
property with the express consent of the property owner, and provided they do not
impede safety by obstructing vision of pedestrians or motor vehicle operations.

570_25_ Prohibited signs. The following types of signs are prohibited:
a) illuminated flashing, rotating or animated;
b) signs painted, attached or in any other manner affixed to trees, rocks, or
similar natural surfaces, or attached to public utility poles, bridges,
towers, or similar public structures;
any sign, device, lamp or light which is so constructed, operated or used
that illumination emanating therefrom is concentrated or beamed is hereby
prohibited except that in zoning district B -3, B -4, 1 -1 and 1 -2,
searchlights for advertising purposes may be used from and upon private
property for a period of not to exceed three days in any period of 30
consecutive days;
signs which by reason of position, shape or color, would detract from or
otherwise interfere with the proper functioning of a traffic control sign
or signal;
signs that resemble any official marker erected by a governmental agency
or display such words as "stop" or "danger except official traffic
control signs, and except in planned developments served with private
streets traffic control signs may be used where approved by the city
engineer_
