CONDITIONAL USE PERMIT - NOAH'S ARK DAYCARE

Proposed Action.
Staff recommends approval of the following motion: "Move approval of
Resolution No: Z89 -12 with conditions to allow daycare at 1408
Mainstreet."
Approval of this motion will allow Noah's Arch Daycare Center to
operate at 1408 Mainstreet.
Overview.
Noah's Ark Daycare Center is requesting a Conditional Use Permit to
operate a daycare at 1408 Mainstreet in Central Park Square. The
ordinance requires, that daycares in a B -3 district receive a
conditional use permit.
Noah's Ark Daycare is currently located in Cross of
the southwest corner of Shady Oak and County Road 3.
Staff is recommending approval because the applicants meet the
requirements for a conditional use permit to operate a daycare in a 137
3 district.

General Background.
The applicants currently operate their daycare center at the Cross of
Glory Church on the southwest corner of Shady Oak Road and County Road
3. The applicants have been at this site for 4 1/2 years. The
applicants stated they feel that the new site would not only be of a
benefit to them but with all the families coming to the center.
The center will consist of 95 children when fully operational. The
applicants are proposing to have 24 infants, 21 toddlers, 40 preschool
with an option of another room for 10 -15.
The center will be open from 6:30 a.m. to 6:00 p.m. Monday through
Friday.
Ordinance Requirements.
The Zoning Ordinance allows daycare in the B -3 district with the
following conditions:
1. an area of 50 square feet or more per design capacity is
provided outside, enclosed by a five foot high appropriately
designed fence.
2. said operation shall have a state permit.
When the addition was constructed to the old County Club Market there
was enough parking in the lot to meet the most intense parking
requirement, which is retail. The daycare use does not increase the
parking requirements. The parking area will provide ample parking for
the parents when dropping off their children.
Primary Issues to Consider.
o Does the applicant's request meet the requirements for a
Conditional Use Permit?
There are two requirements that the applicant must meet for the
conditional use permit. The applicant has met both of these
requirements.
The applicants will have an enclosed area in the back of the building
of 50 square feet for the children to play. However, the children
will also use Central Park for a play area. The State has approved
Central Park for a play area.
The applicants currently have a State license for daycare at their
existing location and will secure a license at the proposed location.
Alternatives.

1. Approve the conditional use permit with conditions to operate
a daycare at 1408 Mainstreet. By approving the conditional
use permit the applicants will be able the operate the
proposed daycare center.
2. Deny the conditional use permit to operate a daycare at 1408
Mainstreet. By denying the conditional use permit the
applicants will not be able to operate the proposed daycare
center. If the Commission chooses this alternative they will
have to establish findings of fact that support this decision.
Staff is not recommending this alternative.
3. Continue for further information. If the Commission feels
that further information is needed, the item should be
continued.

Our operation when fully going will consist of approximately 95 children. This
will include 24 infants, 21 toddlers, 40 preschool with an option of another roan
icensable for 10 -15.
The staff we will employee will depend on the ratio of children in accordance with
the Minnesota State Licensing guidelines. We will be open fran 6:30am to 6 :00pm
Monday thru Friday.
We have been in operation the. last 4 1/2 years in the Cross of Glory Church on
Shady Oak and Excelsior. Blvd, less than one mile from the location where we
are asking permission to move to.
We have enjoyed being in this area and feel that the new site would not only be
of a benefit to us but with all the families coming to our center it would enhance
the business climate of the Hopkins Downtown area.
Also find attached a rough draft of the building plans for the Noah's Ark Center
at Central Park Square. We will send a revised plan to the City of Hopkins upon
approval of the floor plans.

RESOLUTION NO: Z89 -15
RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL
OF APPLICATION FOR CONDITIONAL USE PERMIT CUP89 -12
WHEREAS, an application for a Conditional Use Permit
entitled CUP89 -12 made by Noah's Ark Child Care,
to operate a Day Care at 1408 Mainstreet,
is recommended for approval.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for Conditional Use
Permit CUP89 -12 was filed with the City of
Hopkins on August 3, 1989.
2. That the Hopkins Planning Commission reviewed
such application on August 29, 1989.
3. That the Hopkins Planning Commission,
pursuant to published and mailed notices,
held a public hearing on August 29, 1989: all
persons present at the hearing were given an
opportunity to be heard.
4. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for
Conditional Use Permit CUP89 -12 is hereby
recommended for approval subject to the following
Findings of Fact:
1 . That the day care is a conditional use within
the B -3 district.
2. That the proposed day care meets the
conditions for day care.
