CONDITIONAL USE PERMIT - HARLEY HOPKINS PLAYGROUND

Proposed Action.
Staff recommends approval of the following motion: "Move approval of
Resolution No: Z89 -16 to allow construction of a storm water retention
pond at Harley Hopkins Family Center."
Adoption of this motion will allow construction of a retention pond
with activities at Harley Hopkins Family Center.
Overview.
The City is proposing to construct a storm water retention pond at
Harley Hopkins Family Center. A conditional use permit is required
because the project requires the moving of over 400 cubic yards of
earth material.
After the July 23, 1987 rainstorm, the City Council ordered a study of
the storm water problems in the City. The area around the
intersection of Jackson Avenue South and First Street South has been
subject to frequent flooding. As a result of that study, a retention
pond has been recommended for the easterly portion of the Harley
Hopkins Family Center.
Staff is recommending approval because the retention pond is needed
for storm water retention and would also provide a new recreation
area.

will prevent access to the retention pond when there is water in it.
It is estimated that the pond will have water in it 3 -4 times a year.
The City will maintain the warming house and the fields on the site.
As of the date of this report the School Board has not given approval
of the proposed retention pond. It will be reviewed by the School
Board on August 24th.
The City held a public information meeting on July 31, 1989 to discuss
the retention pond with the surrounding neighborhood. Generally - the
neighborhood was in favor of the proposed pond.
The construction of the pond will be paid for with storm water utility
funds.
A new parking area will be created on the south side of Harley Hopkins
because the existing parking area is located where the proposed pond
will be constructed.
The attached plan is only a concept, the City Council will approve the
final plan.
Primary Issues to Consider?
Is the storm water retention pond needed?
The area of Jackson Avenue South and First Street South has had
trouble with flooding during summer rainstorms. The worst rainstorm
being two years ago when many homes in Hopkins had a great deal of
water damage.
There are two solutions to alleviate the flooding problem in the
area. The first being the construction of a retention pond and the
second upgrading the storm water system.

The second solution may not be achievable because of the Watershed
Districts. Minnehaha Watershed District will not allow the City to
direct more water to Minnehaha Creek. Nine Mile Watershed will allow
more water to be directed to the Creek, but it must be stored upstream
and dispersed slowly. If the Watershed Districts allowed the storm
water system to be upgraded, the cost is estimated at 2 -3 million.
The only solution left to alleviate the flooding in this area is to
construct a retention pond to slowly disperse the water into Nine Mile
Creek. The cost of constructing the retention pond is approximately
$400,000.
o What are the impacts on the surrounding area?
There should only be a positive impact to the surrounding area. The
neighborhood will get a new recreation area plus the flooding
situation should be solved.
At 3 -4 times a year there will be water in the retention pond.
However, there will be a 6 foot fence surrounding the retention pond
to keep people out of the pond when there is water in it.
Alternatives.
1. Approve the Conditional Use Permit as recommended by staff to
allow the construction of a retention pond. By approving the
conditional Use Permit the City will be able to construct the
retention pond.
2. Approve the Conditional Use Permit with additions /changes. If
the Commission feels that additional conditions should be
added, it should be done at this time.
3. Deny the Conditional Use Permit to allow construction of a
storm water retention pond. Should the Planning Commission
recommend denial, findings of fact will have to be made.
Staff does not recommend denial.
4. Continue for further information or analysis. If the
Commission feels further information is needed, the item
should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING
APPROVAL OF APPLICATION FOR CONDITIONAL USE PERMIT CUP89 -13
WHEREAS, an application for a Conditional Use Permit
entitled CUP89 -16 made by the City of Hopkins
to construct a storm water retention pond at
Harley Hopkins Family Center is hereby recommended
for approval.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for Conditional Use
Permit CUP89 -16 was filed with the City of
Hopkins on August 4, 1989.
2. That the Hopkins Planning Commission reviewed
such application on August 29, 1989.
3. That the Hopkins Planning Commission,
pursuant to published and mailed notices,
held a public hearing on August 29, 1989: all
persons present at the hearing were given an
opportunity to be heard.
4. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that application for
Conditional Use Permit CUP89 -13 is hereby
recommended for approval subject to the following
Findings of Fact:
1. That the formation of a retention pond will
enhance the area.
2. That the City will maintain the site as a
recreation area.
