SUBJECT: Proposed Commercial Kennel Ordinance
This is a public hearing for the attached ordinance that would
allow commercial kennels in the Industrial Districts.
To clear up the confusion of what is an animal, I have added a
definition that defines an animal. I also added language that
says if the building is a dwelling unit you can have more than 3
animals. However, the City Code only allows residents to have 2
dogs.
The added language is consistent with the City Code.
The Commission action is to recommend to the Council approval of
the proposed ordinance.

RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL
OF ORDINANCE NO. 642 RELATINIG TO DOG KENNELS
IN INDUSTRIAL DISTRICTS
WHEREAS, a proposed amendment, Ordinance No.642, regarding
Dog Kennels in Industrial Districts is recommended
for approval.
WHEREAS, the procedural history of the amendment is as
follows:
1. That the Hopkins Planning Commission reviewed
such amendment on June 25, 1989.
2. That the Hopkins Planning Commission,
pursuant to published notice, held a public
hearing on July 25, 1989, and August 29,
1989: all persons present at the hearing were
given an opportunity to be heard.
3. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that proposed Ordinance No.
642 regarding dog kennels in I Districts is hereby
recommended for approval with the following
Findings of Fact:
1. That a dog kennel is a compatible use with the
other permitted uses in the Indusrial Districts.

ORDINANCE NO: 89 -642
AN ORDINANCE AMENDING SECTIONS 515 AND 540
OF THE HOPKINS ZONING ORDINANCE
REGARDING KENNELS
BE IT ORDAINED by the City Council of the City of Hopkins as
follows:
That Section 515 of the Hopkins Zoning Ordinance be and the same
is hereby amended by revision and there is hereby enacted and
adopted in place thereof the following sub - section:

Subd. 7 Animal: means any warm blooded mammal,
inclusive of, but not limited to dogs and cats, as well
as any reptiles or birds of prey. For purposes of this
ordinance, when the specific animal type is not
described, such as dog, the term animal shall apply to
all forms of animals as described herein.
Subd. 22 Commercial kennel: a premises which is not a
dwelling unit where three or more animals, at any one
time, over six months of age are owned, boarded, bred
or offered for sale.
That the Hopkins Zoning Ordinance No. 540 be and the same is
hereby amended by adding the following provisions:
