Resolution NO:RZ93-24 CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: RZ93 -23 RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING DENIAL OF AN AMENDMENT TO A CONDITIONAL USE PERMIT TO CLOSE THE NORTHERLY ACCESS ON 11TH AVENUE WHEREAS, an application for a conditional use permit CUP93 -11, made by Holiday Companies to close the northerly access on 11th Avenue one year after occupancy is recommended for denial. WHEREAS, the procedural history of the application is as follows: 1. That an application for an amendment to a conditional use permit CUP93 -11 was filed with the City of Hopkins on September 21, 1993. 2. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on the application and reviewed such application on October 26, 1993: all persons present at the hearing were given an opportunity to be heard. 3. That the written comments and analysis of the City staff and Y Y the Planning Commission were considered. NOW THEREFORE, BE IT RESOLVED that the application for an amendment to a conditional use permit CUP93 -11 is hereby recommended for denial based on the following Findings of Fact: 1. The close proximity of the northerly driveway on llth Avenue to County Road 3 does not provide adequate sight distance when a vehicle is pulling out of the property onto llth Avenue. 2. The close proximity of the northerly driveway on 11th Avenue creates a conflict with the free right turn lane from County Road 3. 3. R ,Chair P erson •t CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: RZ93 -24 RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A SIDE YARD VARIANCE AT 510 SWEETBRIAR WHEREAS, an application for a variance VN93 -6, made by Gerald Story to allow a 5 foot side yard variance to construct an addition to the garage is hereby recommended for approval. WHEREAS, the procedural history of the application is as follows: 1. That an application for a variance VN93 -6 was filed with the City of Hopkins on September 20, 1993. 2. That the Hopkins Planning Commission, pursuant to mailed notices, held a meeting on the application and reviewed such application on October 26, 1993: all persons present were given an opportunity to be heard. 3. That the written comments and analysis of the City staff and the Planning Commission were considered. NOW THEREFORE, BE IT RESOLVED that the application for variance VN93 -6 is hereby recommended for approval based on the following Findings of Fact: 1. That the applicant has an undue hardship due to the unique and special circumstances associated with this property and its relationship to Highway 7 and the sound barrier located on the north side of the property.
