RESOLUTION NO: RZ93 -6
RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING
APPROVAL OF AN APPLICATION FOR A CONDITIONAL USE PERMIT
WHEREAS, an application for a conditional use permit CUP 93 -3,
made by Minnegasco is recommended for approval.
WHEREAS, the procedural history of the application is as follows:
1. That an application for a conditional use permit CUP 93 -3 was
filed with the City of Hopkins on February 25, 1993.
2. That the Hopkins Planning Commission, pursuant to published and
mailed notices, held a public hearing on the application and
reviewed such application on March 30, 1993: all persons present
at the hearing were given an opportunity to be heard.
3. That the written comments and anaysis of the City staff and the
Planning Commission were considered.
41115. That the legal description of the property is as follows:
That part of Tract C, Registered Land Survey number 291,
according to the plat thereof on file and of record in the Office
of the Registrar of Titles in and for said Hennepin County, as
memorialized on Certificate of Title number 642115, described as:
Beginning at the Southwest corner of said Tract C; thence
Northerly along the West line of said Tract C, a distance of
82.83 feet; thence Easterly, measured at right angles, a
distance of 101.00 feet; thence Southerly, measured at right
angles, to the intersection with the Southerly line of said
Tract C, said point also being the Northerly right -of -way of
County State Aid Highway number 5 (A.K.A. Minnetonka
Boulevard); thence Southwesterly along the Southerly line of
said Tract C to the point of beginning and there
terminating.
And:
That part of the Southeast Quarter of the Northeast Quarter (SE
1/4 of the NE 1/4) of Section 14, Township 117, Range 22, said
Hennepin County, as memorialized on Certificate of Title number
479477, described as:
41, Beginning at the intersection with a line 150.00 feet
Easterly of and parallel with the West line of said SE 1/4

of the NE 1/4 and the Northerly right -of -way of said
Minnetonka Boulevard described above; thence Northerly along
said line 150.00 feet Easterly of and parallel with the West
line of SE 1/4 of the NE 1/4 a distance of 82.83 feet;
thence Westerly along a line parallel with the North line of
said SE 1/4 of the NE 1/4 a distance of 37.00 feet; thence
Southerly, parallel with the West line of said SE 1/4 of the
NE 1/4 to the intersection with the Northerly right -of -way
of said Minnetonka Boulevard; thence Northeasterly along the
Northerly right -of -way of said Minnetonka Boulevard to the
point of beginning and there terminating.
NOW THEREFORE, BE IT RESOLVED that the application for
conditional use permit CUP 93 -3 is hereby recommended for approval
based on the following Findings of Fact:
1. That the proposed building meets the requirements for the R-
1-D Zoning District.
2. That the proposed building meets the requirements for the
conditional use permit.
41/ BE IT FURTHER RESOLVED, that application for CUP 93 -3 is hereby
recommended for approval based on the following conditions:
1. That the proposed building's exterior is painted with an
earthtone color.
