Agenda/Commission Minutes A regular meeting of the Zoning and Planning Commission was
held on Tuesday, January 28, 1992 at 7:30 p.m. in the
Council Chambers of Hopkins City Hall.
Present were Chairman Pavelka, members Hutchison, Racek,
Day, Reuter, Chapman, and Redepenning. Also present was
staff member Nancy Anderson and City Attorney Jerre Miller.
CALL TO ORDER
Chairman Pavelka called the meeting to order at 7:30 p.m.
ITEM:
Commissionmember Reuter noted a correction to the minutes in
the vote on VN 91 -2 Sign Variance for the Embers. Anderson
is not a voting member of the Commission and the minutes
were corrected to reflect this. Reuter then moved and
Commissionmember Chapman seconded the motion to approve the
minutes of the December 30, 1991 meeting. The motion
carried unanimously.
CASE NO:
VAC 91 -4 VACATION OF TYLER AVENUE EDCO PRODUCTS
Public hearing to consider vacating a portion of Tyler
Avenue abutting 845 Excelsior Avenue East.
Nancy Anderson reviewed the request with the Commission.
Staff recommended denial of the request on the grounds that
Tyler Avenue could become a through street in the future.
Attorney Wilhelme and Steve Hanlon representing Edco
Products stated that all other options had been explored,
but that no other option meets their needs.
Mr. Pavelka opened the public hearing at 8:25 p.m. There
were no questions from the floor. Mr. Pavelka closed the
public hearing at 8:26 p.m.
Commissionmember Hutchison moved to approve vacation of the
largest portion of Tyler Avenue possible. There was no
second to the motion.
Commissionmember Winship moved to recommend staff
investigate a study focusing on the Tyler Avenue connection
to be completed before the next Zoning and Planning meeting,
and to continue the application to that meeting. Motion
seconded by Pavelka. Commissionmembers Pavelka, Winship,
Hutchison, Day, Chapman, and Reuter voted aye. Racek
abstained.

CASE NO:
ZCR 92 -2 CONCEPT REVIEW HARTMAN DEVELOPMENT CORPORATION
Hearing to consider an application by Hartman Development
Corporation for a concept review to construct a grocery
store at 2012 Mainstreet (the current site of the Pines
Mobile Home Park).
Nancy Anderson reviewed the request with the Commission.
Mr. Dick Dreher from Hartman Development Company appeared
before the commission to explain the plans for a state of
the art grocery store with room for expansion. The project
would require no City funding. Mr. Hartman is a partner in
the development company as well as a part owner of the Pines
Mobile Home Park. Several people from the neighborhood
asked questions about the traffic flow, lighting of the
parking lot, late night traffic, screening of the
surrounding residential areas, late night truck traffic, and
cruisers. There were no residents of the Pines at the
meeting.
Commissionmembers discussed the implications of rezoning and
Chapman stated that he supported the concept review stage.
Commissionmember Reuter stated she was comfortable with the
plan if the neighborhood is preserved. Mr. Pavelka stated
he would support project if the neighborhood was protected.
Nancy Anderson will pass the information from the discussion
to the City Council.
The Zoning and Planning Commission recessed at 9:35 and
reconvened at 9:40.
CASE NO:
VN 92 -1 ORDINANCE AMENDMENT ADULT ORIENTED USES
Public Hearing to consider an ordinance amendment to
regulate adult oriented uses.
Staff member Nancy Anderson presented an overview. The
amendment would regulate adult oriented businesses in the
B -3 district. Commissionmembers Winship moved and Racek
seconded a motion to approve VN92 -1 to amend the Adult
Oriented Uses Ordinance. The motion carried unanimously.
ITEM:
FENCES IN INDUSTRIAL DISTRICT
Discussed proposed ordinance regarding fences in industrial
district. Commission directed staff to set a public hearing

for the proposed ordinance which would require fences in the
industrial district to have set backs.
ITEM:
BUSINESS PARK DISTRICT ORDINANCE
Discussed proposed ordinance and directed staff to continue
to work on document.
ITEM
CHURCHES IN THE B -2 AND B -3 DISTRICTS
Discussed allowing churches in business districts. Nancy
Anderson referred to a recent court ruling in Hastings.
This item was referred to Jerre Miller.
Winship moved and Reuter seconded the motion to adjourn the
meeting at 10:OOp.m. The meeting adjourned by unanimous
consent.
