III ZONING AND PLANNING COMMISSION MINUTES
July 26, 1994
A regular meeting of the Zoning and Planning Commission was held on Tuesday, July, 26, 1994
at 6:30 p.m. in the Council Chambers of Hopkins City Hall.
Present were Commission members Gullickson, Racek, Day, Johnson, Hutchison, Schumacher,
and B. Anderson.
Also present were staff member Nancy Anderson and City Attorney Jerre Miller.
CALL TO ORDER
Because both the Chairperson and Vice -Chair terms expired after the last meeting, the meeting
was called to order at 6:30 by staff member Nancy Anderson.
ELECTION OF OFFICERS
Mr. Racek moved and Mr. Gullickson seconded a motion to waive using ballots for the election
of officers. The motion was approved unanimously.
Mr. Day moved and Mr. Racek seconded a motion to nominate Dan Johnson for Chairperson.
Mr. Racek moved and Mr. Gullickson seconded a motion to close nominations for Chairperson.
Mr. Johnson was approved unanimously for Chairperson.
Mr. Racek moved and Mr. Hutchison seconded a motion to nominate Mr. Gullickson Vice Chair.
Mr. Racek moved and Mr. Day seconded a motion to close nomination for Vice Chair. Mr.
Gullickson was approved unanimously for Vice Chair.
APPROVAL OF MINUTES
Mr. Gullickson moved and Mr. Racek seconded a motion to approve the minutes of the June 28,
1994 meeting. The motion carried unanimously.
CASE NO. CUP94 -2 CONDITIONAL USE PERMIT HANUS BUS
Staff reviewed the application for the Commission. Mr. Hanus, the applicant appeared before the
Commission.
The public hearing was opened at 6:55. Jim Justus appeared before the Commission. Mr. Justus
was concerned about the bus traffic on County Road 3. The public hearing was closed at 7:00.
The Commission discussed the access into the site. Mr. Hutchison felt the staff and the applicant
were too far apart on the access issue and that it would be wise to continue the item for a month
to provide time for the staff and the applicant to discuss the access and hopefully to work out a
solution.
Mr. Hutchison moved and Mr. Racek seconded a motion to continue CUP94 -2 to the August
meeting. The motion passed unanimously.
CASE NO. VN94 -2 VARIANCE SUBDIVISION MORATORIUM ORDINANCE
Staff reviewed the variance request from the subdivision ordinance with the Commission. Susan
Hayes, the applicant appeared before the Commission.
Mr. Hutchison moved and Mr. Day seconded a motion to approve Resolution RZ94 -8,
recommending denial of a variance from the subdivision moratorium ordinance. The motion
carried unanimously.
CASE NO. ZCR94 -3 CONCEPT REVIEW COUNTY ROAD 3 AND 11TH AVENUE
Staff informed the Commission that the applicant has requested that the item be continued. Mr.
Day moved and Mr. Racek seconded a motion to continue ZCR94 -3 to the August meeting. The
motion carried unanimously.
ITEM: REVIEW DRAFT SUBDIVISION ORDINANCE
Staff reviewed the proposed ordinance with the Commission. Staff stated that input for the
proposed amendments came from the City Attorney and the City Engineer. Also, Mark Koegler
a planing consultant is in the process of reviewing the amendments and there maybe some slight
changes at the next meeting. The Commission reviewed several sections with the staff. Several
residents from the Bellgrove area spoke regarding their suggestions for amendments to the
subdivision ordinance.
Mr. Hutchison moved and Mr. Day seconded a motion to set a public hearing for August 30,
1994 for the proposed amendments to the Subdivision and Zoning Ordinance.
ITEM: REVIEW SETBACKS
Staff reviewed the current residential setbacks and the problems with determining what the actual
setbacks are in north Hopkins. The Commission indicated that the existing setbacks were
acceptable.
Mr. Racek moved and Mr. Hutchison seconded a motion to adjourn the meeting. The meeting
adjourned by unanimous consent.
