Commission Minutes ZONING AND PLANNING COMMISSION MINUTES
December 27, 1994
A regular meeting of the Zoning and Planning Commission was held on Tuesday, December 27,
1994 at 6:30 p.m. in the Council Chambers of Hopkins City Hall.
Present were Commission members Gullickson, Day, Johnson, Hutchison, Schumacher, and
Kinnich.
Also present was staff member Nancy Anderson.
CALL TO ORDER
APPROVAL OF MINUTES
Mr. Gullickson moved and Ms. Kinnich seconded a motion to approve the minutes of the
November 29, 1994 meeting. The motion carried unanimously.
CASE NO. ZCR94 -5 CONCEPT REVIEW R.L. JOHNSON PROPERTY
Staff reviewed the ro osed concept with the Commission. Chuck Youngquist, representing the

applicant appeared before the Commission. Mr. Youngquist reviewed the site plan with the
Commission. The Commission asked questions regarding, traffic, access, hours of operation, and
number of employees.
The Commission's review of the concept was positive and hoped the site development would
proceed as proposed.
CASE NO. CUP94 -8 CONDITIONAL USE PERMIT WENDY'S
Staff recommended that this item is continued to the January meeting. Mr. Hutchison moved and
Mr. Day seconded a motion to continue CUP94 -8 to the January meeting. The motion carried
unanimously.
CASE NO. SUBD94 -4 PRELIMINARY/FINAL PLAT WENDY'S
Staff recommended that this item is continued to the January meeting. Mr. Hutchison moved and
Mr. Day seconded a motion to continue SUBD94 -4 to the January meeting. The motion carried
unanimously.
CASE NO. ZN94 -4 COMP94 -2 ZONING AMENDMENT /COMPREHENSIVE PLAN
AMENDMENT OPUS
Staff reviewed the proposed rezoning and Comprehensive Plan amendment with the Planning
Commission. The public hearing was opened at 7:04. There was no one to speak at the public
hearing. Mr. Hutchison moved and Mr. Gullickson seconded a motion to close the public hearing
at 7:05. The motion carried unanimously.
Mr. Hutchison moved and Mr. Day seconded a motion to approve Resolution RZ94
recommending approval of a rezoning and Comprehensive Plan change for the Opus property.
The motion carried unanimously.
CASE NO. VN94 -4 HEIGHT VARIANCE 105 16TH AVENUE NORTH
Staff reviewed the proposed height variance with the Commission. Staff noted that another letter
had been submitted by a neighbor opposing the variance and has been provided to the
Commission. Dan Johnson, the applicant appeared before the Commission. Mr. Johnson stated
that they wanted a 10/12 pitch to the roof to match the existing home. Mr. Hutchison stated that
the applicant does have reasonable use of the property and no hardship to grant a variance.
Mr. Hutchison moved and Mr. Day seconded a motion to approved Resolution RZ94 -21
recommending denial of a height variance at 105 16th Avenue North. The motion was approved
on a 5 -0 vote. Mr. Schumacher abstained from voting.
Mr. Johnson moved and Ms. Kinnich seconded a motion to adjourn. The motion carried
unanimously.
