Commission Minutes IIP regular meeting of the Zoning and Planning Commission was held on
u esday, September 29, 1992 at 7:30 p.m. in the Council Chambers of
Hopkins City Hall.
Present were Commission members Hutchison, Winship, Racek, Day,
Reuter, Johnson, Gullickson and Redeppenning.
Also present were staff members Nancy Anderson, Paul Steinman and Lee
Gustafson, and City Attorney Jerre Miller.
CALL TO ORDER
The meeting was called to order at 7:30 by Chairman John Hutchison.
ITEM:
APPROVAL OF MINUTES
Mr. Gullickson moved and Ms. Reuter seconded the motion to approve the
minutes of the August 25, 1992 meeting. The motion carried
unanimously.
CASE NO:
ZN 92 -4 REZONE HOYT DEVELOPMENT
Public hearing to consider an application by Hoyt Development for a
rezoning of the vacant 13 acre site south of County Road 3 from I -2 to
PUD.
COM 92 1 COMPREHENSIVE PLAN CHANGE HOYT DEVELOPMENT
Public hearing to consider changing the comprehensive plan from
Business Park to Business at the vacant 13 acre site south of County
Road 3.
CASE NO:
CUP 92 -6 CONDITIONAL USE PERMIT HOYT DEVELOPMENT
Public hearing to consider an application by Hoyt Development for a
conditional use permit to construct a grocery store /retail area at the
vacant 13 acre site south of County Road 3.
SUBD 92 4 PRELIMINARY PLAT HOYT DEVELOPMENT
Public hearing to consider a preliminary plat for the vacant 13 acre
parcel south of County Road 3.
Staff informed Commission members that they had received a letter this
day from Hoyt Development Company asking to withdraw the preliminary
11/1 plat from the agenda.

The public hearing was opened at 7:38.
No one appeared in regards to these items.
The public hearing was closed at 7:39.
Mr. Winship made a motion to continue ZN 92 -4, COM 92 -1 and CUP 92 -6
until the October meeting.
The motion was seconded by Mr. Racek.
The motion passed unanimously.
ITEM:
CASE NO:
CUP 92 -7 CONDITIONAL USE PERMIT EDCO PRODUCTS
Public hearing to consider an application for a conditional use permit
by Edco Products to construct a 66,240 square foot addition at 802
Second Street NE.
Mr. Racek absented himself from the Council Chambers.
Staff reviewed the applicant's request and stated that applicant has
made changes to comply with staff recommendations. There are still
some changes remaining to be made.
A petition was presented from Gary Schatz with signatures of residents
supporting removing or setting back the fence from the street.
David Kirscht representing Edco appeared before the Commission and
reviewed the plans for the addition. Mr. Kirscht stated the site plan
had been revised to move the majority of the fence back from the
Second Street alley. Mr. Kirsch also stated that the entire length of
fencing will be new.
The public hearing was opened at 7:45.
Concerns from the neighbors regarded refuse blowing around the
neighborhood and the fence.
Robert Johnson, the contractor for Edco, reviewed the proposed plans
for the exterior of the building. The entire building exterior will be
painted with a neutral undercoat and a light brown brick facia.
There was considerable discussion regarding the placement of the fence
on the west part of the site. The Commission recommended that the
staff work with the applicant to minimize the exposed fence on the
site before the Council meeting.
A motion to close the public hearing was made by Mr. Winship at 8:35.

A motion was made by Mr. Winship to approve Resolution RZ92 -23
recommending approval of a conditional use permit to construct a
warehouse addition at 802 Second Street Northeast.
The motion was seconded by Ms. Reuter.
The motion passed unanimously.
CASE NO:
CUP 92 -8 CONDITIONAL USE PERMIT HANDICAP HOUSING
Public hearing to consider an application by the National Handicap
Housing Institute, Inc. to construct a 24 unit apartment building at
the northwest corner of Fifth Avenue and Second Street.
Staff reviewed the request for the Commission.
Commissionmember Gullickson left the meeting at 8:30 p.m.
•The public hearing was opened at 8:45.
Mike Bjerkesett of the Handicap Housing Institute reviewed the
proposal with the Commission. The applicant has revised the site plan
to meet with most of the required setbacks and the concerns of the
City Engineer. Several surrounding residents appeared before the
Commission. One of their concerns was with the HRA parking lot for
Dow Towers. The Commission recommended that the HRA parking lot carry
through with the same landscaping as the Handicap Housing landscaping.
A motion to close the public hearing was made by Ms. Reuter at 9:15.
The motion was seconded by Mr. Day.
The motion passed unanimously.
A motion was made by Mr. Johnson to approve Resolution RZ92 -25
recommending approval of a conditional use permit to construct a 24
unit handicap housing building.
The motion was seconded by Mr. Day.

CASE NO:
VAC 92 -2 VACATION OF ALLEY HANDICAP HOUSING
Public hearing to consider an application by the National Handicap
Housing Institute, Inc. to vacate the east /west alley south of 44
Fifth Avenue South.
Staff reviewed the vacation of the alley with the conditional use
permit proposal.
The public hearing was opened at 9:20.
Two neighbors appeared at the meeting and approved of the alley
vacation because it was felt the alley was dangerous with respect to
its relationship with Fifth Avenue. Staff received a letter from one
of the neighbors objecting to the alley vacation. The Commission
asked if the project could proceed if the alley was not vacated. Mr.
Bjerkesett stated the project could not proceed without the vacation
of this alley.
A motion to close the public hearing was made by Reuter at 9:25.
The motion was seconded by Mr. Day.
The motion passed unanimously.
A motion was made by Mr. Johnson to approve Resolution RZ92 -24
recommending approval of a Ordinance 92 -716 vacating the east /west
alley south of 44 Fifth Avenue South.
The motion was seconded by Mr. Winship.
The motion passed unanimously.
CASE NO:
VN 92 -6 FRONT YARD VARIANCE
Hearing to consider an application by the National Handicap Housing
Institute, Inc. for a variance to park in the front yard setback.
Staff reviewed the request with the Commission. Staff stated that
there will be a large landscape area which will appear as the front
yard setback, but this area is really Second Street right of way. No
one appeared in regards to this matter and there was little
discussion.
A motion was made by Mr. Johnson to approve Resolution RZ92 -26
recommending approval of a variance to park in the front yard setback.

MISC 92 -1 CREATION /MODIFICATION OF TAX INCREMENT DISTRICT 2.6
Staff reviewed the proposal with the Commission. It is proposed to
develop Tax Increment District 2.6 for the construction of the
Handicap Housing Project.
There was considerable discussion.
A motion was made by Mr. Winship to approve Resolution RZ92 -28 finding
the document entitled "Modification of Redevelopment Project Area #1
and #2 and Establishment of Tax Increment District 2.6 consistent with
the plans for development of the City of Hopkins.
The motion failed for lack of a second.
After additional discussion, a motion was made by Mr. Winship to
approve Resolution RZ92 -28.
The motion failed for lack of a second.
A motion was made by Mr. Hutchison for creation of Tax Increment
District 2.6.
.The motion failed for lack of a second.
There was further discussion.
A motion was made by Mr. Racek to approve Resolution RZ92 -28.
The motion was seconded by Mr. Winship.
Day, Johnson, Racek, Reuter, and Winship voted aye.
Hutchison voted nay.
Gullickson was absent.
The motion passed.
CASE NO:
VN 92 -5 FRONT YARD VARIANCE HOPKINS LIBRARY
Hearing to consider an application by Hennepin County for a variance
to park in the front yard setback.
Staff reviewed the item for the Commission members. Jim O'Brian
representing the applicant reviewed the proposal with the Commission.
41111 Several residents appeared and were concerned with the parking lot
access to the alley. Mr. O'Brian stated that the access to the alley
could be removed by constructing a curb.

A motion was made by Mr. Day to approve Resolution RZ92 -22
recommending approval of a variance to park in the front yard setback.
The motion was seconded by Ms. Reuter.
The motion passed unanimously.
ITEM: REVIEW MULTIPLE FAMILY ZONED SITES
This item was continued to the next meeting.
Mr. Racek moved and Mr. Winship seconded the motion to adjourn the
meeting at 10:45 p.m. The meeting adjourned by unanimous consent.
