Commission Minutes (7) IF ZONING AND PLANNING COMMISSION MINUTES May 28, 1996 A regular meeting of the Zoning and Planning Commission was held on Tuesday, May 28, 1996, at 6:30 p.m. in the Council Chambers of Hopkins City Hall. Present were Commission members Pat Gleeson, Sid Blair, Dan Johnson, Kate Kinnich, Rick Brausen, Bill Schumacher, Bill Gullickson, and Council Representative Gene Maxwell. Also present was City Planner Nancy Anderson and City Attorney Jerre Miller. CALL TO ORDER Chairperson Johnson called the meeting to order. APPROVAL OF MINUTES Mr. Schumacher moved and Mr. Gleeson seconded a motion to approve the minutes of the April 30, 1996, meeting. The motion carried unanimously. CASE NO. SUBD96 2 PRELIMINARY/FINAL PLAT 401 11TH AVENUE SOUTH Ms. Anderson reviewed the proposed plat for the R.L. Johnson property. The conditional use permit to construct the office /warehouse required the subject property to be platted by December 1997. Robb Johnson, the applicant, appeared before the Commission. Mr. Brausen arrived at the meeting at this time. The public hearing was opened at 6:38 p.m. No one came forward to speak. Mr. Gullickson moved and Mr. Blair seconded a motion to close the public hearing at 6:39 p.m. The motion was approved unanimously. Mr. Blair moved and Mrs. Kinnich seconded a motion to approve Resolution RZ96 8, recommending approval of a preliminary/final plat at 401 -11th Avenue South. The motion was approved unanimously. CASE NO. CUP96 3 CONDITIONAL USE PERMIT -REAL ESTATE EQUITIES Ms. Anderson reviewed the proposed development. Ms. Anderson noted that the applicant will be applying for a rezoning at a later date. Ch uc ddyh tear c c et p g q pp Mr. Liddy reviewed the site plan with the Commission. Mr. Liddy stated that all the units will have basements that can be a future bedroom or family room. Mr. Liddy also asked the Commission if the sidewalk on Mainstreet could be completed once Shady Oak Road is upgraded. There was considerable discussion regarding the sidewalk on Mainstreet. Mrs. Kinnich wanted a sidewalk constructed during the project for safety reasons. The Commission added a condition to the Resolution, that the applicant would not have to construct the sidewalk on Mainstreet until Shady Oak Road is reconstructed. The Commission also discussed the proposed fence for the site. The Commission is reserving the right to review the final fence design once it has been determined. Mr. Liddy also discussed the signage for the site. Ms. Anderson noted that the applicant will have to request a variance and a conditional use permit for all the signage the applicant is proposing. The public hearing was opened at 7:29 p.m. No one came forward to speak. Mr. Blair moved and Mrs. Kinnich seconded a motion to close the public hearing at 7:30 p.m. The motion was approved unanimously. Mr. Blair moved and Mr. Schumacher seconded a motion to approve Resolution RZ96 10, recommending approval of a conditional use permit to construct 66 townhomes at the southeast corner of Mainstreet and Shady Oak Road. Mr. Schumacher moved to amend the Resolution to include the following: o Retain the existing sidewalk on Mainstreet o Add sidewalk west of the ingress /egress during the Shady Oak Road reconstruction o Review the fencing when the applicant determines the style and type o Review the proposed signs when the applicant applies for a variance and /or a conditional use permit Mr. Gullickson seconded this amendment. The motion to amend the original motion was approved unanimously. The motion to approve Resolution RZ96 -10 with the amendments was approved unanimously.
