Resolution NO:RZ97-2 CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: RZ97 -2 RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT TO CONSTRUCT 64 TOWNHOMES ON THE PROPERTY NORTH OF ST. THERESE WHEREAS, an application for Conditional Use Permit CUP97 -1 has been made by Stuart Nolan; WHEREAS, the procedural history of the application is as follows: 1. That an application for a conditional use permit was made by Stuart Nolan on January 24, 1997; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on February 25, 1997: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: Lot 1, Block 1, Opus 2 Ninth Addition NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit CUP97 -1 is hereby recommended for approval based on the following Findings of Fact: 1. That the proposed development meets the requirements for a conditional use permit. 2. That the proposed development meets the zoning requirements. BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP97 -1 is hereby recommended for approval based on the following conditions: 1. That the Engineering Department approves the final stormwater, drainage and grading plan. 2. That Nine Mile Watershed District approves the proposed development. 3. That the site identification sign has a 25 -foot front yard setback. 4. That the fire truck turnaround is modified and approved by the fire marshal. 5. That townhomes will be sprinlded if required by the fire marshal. 6. That there is an agreement with the applicant and the City regarding the maintenance and access of the N.U.R.P. pond. 7. That the applicant upgrade the erosion control measures on the site as per the specifications of the Engineering Department. Adopted this 25th day of 1997. Bill Schumacher, hair III Ill
