Commission Minutes A regular meeting of the Zoning and Planning Commission was held on Tuesday, February 23, 1993 at 7:30 p.m. in the Council Chambers of Hopkins City Hall. Present were Commission members Hutchison, Redepenning, Winship, Racek, Day, Johnson and Reuter. Also present were staff members Nancy Anderson and Lee Gustafson and City Attorney Jerre Miller. Absent was Commission member Gullickson. CALL TO ORDER The meeting was called to order at 7:30 by Chairman John Hutchison. ITEM: APPROVAL OF MINUTES Mr. Racek moved and Ms. Reuter seconded the motion to approve the minutes of the January 26, 1993 meeting. The motion carried unanimously. ITEM: CUP 93 -1 CONDITIONAL USE PERMIT AUTO SALES LOT Public hearing to consider an application by Joe Garber for a conditional use permit to allow an auto sales lot at 525 Mainstreet. The applicant was not present so staff recommended this item be continued to the March 30 meeting. Mr. Winship moved and Mr. Racek seconded that CUP 93 -1 be continued to March 30. The motion passed unanimously. ITEM: CUP 91 -4 CONDITIONAL USE PERMIT CLIFF LAMBERT Review of Cliff Lambert's conditional use permit to operate a contractor's yard at 1402 Fifth Street South. Staff recommended that this item be continued to the March 30 meeting due to a soil problem. Mr. Day moved and Ms. Reuter seconded a motion to continue CUP 91 -4 to the March 30 meeting. 410 The motion passed unanimously. Zoning and Planning Commission Minutes February 23, 1993 Page 2 ITEM: CUP 93 -2 CONDITIONAL USE PERMIT AUTO SALES LOT Public hearing to consider expanding the existing auto sales lot at 420 Mainstreet. The public hearing was opened at 7:40 p.m. Bill Traiser, the building owner, and Doug Sprinthall of Inver Hills Mazda, the tenant, were present. There was discussion about the landscaping and the number of trees. The public hearing was closed at 7:50. Mr. Winship moved and Mr. Day seconded a motion to approve RZ93 -5 recommending approval of an application for a variance, with additional landscaping to be approved by staff. The motion passed unanimously. ITEM: 4111 93 -2 VARIANCE REAR YARD SETBACK Hearing to consider a 5 foot variance to construct a home at 201 West Park Road. Staff reviewed the applicant's request with the Commission. The applicant is a quadraplegic in a wheelchair and needs extra footage in the garage. Without the extra footage it would be difficult to manuever the wheelchair and to get into and out of his van. Several neighbors were present and considerable discussion took place. The neighbors were concerned about the drainage, the placement of the house on the lot, and the size of the home. Archie Carter of 225 West Park Road spoke extensively regarding the private covenants on the property. Chairman Hutchison stated that the matter before the Commission is whether to grant a 5 foot rear yard variance. The City Attorney stated that the City cannot become involved in civil matters such as deed restrictions. Mr. Johnson moved and Ms. Reuter seconded a motion to continue the item to the March 30 meeting. III The motion passed unanimously. Zoning and Planning Commission Minutes February 23, 1993 4111 Page 3 ITEM: CUP 93 -1 CONDITIONAL USE PERMIT AUTO SALES LOT The applicant was now present and asked to have his hearing reopened. Mr. Johnson moved and Mr. Winship seconded a motion to reopen the public hearing for CUP 93 -1 for the auto sales lot at 525 Mainstreet at 9:05 p.m. The motion passed unanimously. Applicant presented plans for planting flowers in the setback. He also stated that he does not want to have the south driveway closed. Staff stated that the CUP requires a 20 foot front yard setback which must be entirely landscaped. The City Attorney supports that interpretation. There was much discussion on the driveway and landscaping. The public hearing was closed at 9:25. 4111 Mr. Johnson moved and Ms. Reuter seconded a motion to continue CUP 93- 1 to the March 30 meeting. The motion passed unanimously. ITEM: REVIEW SIDEWALK /TRAIL PLAN Lee Gustafson presented the sidewalk /trail plan for review by the Commission before preparing a final draft of the plan. The main purpose of establishing a plan is to identify areas where sidewalks and trails are needed. There was much discussion on a possible time frame, who pays for the improvements, which side of the street they would be located on, etc. The plan will be brought before the City Council on March 2 for final review and approval. Mr. Racek moved and Ms. Reuter seconded the motion to adjourn the meeting at 10:05 p.m. The meeting adjourned by unanimous consent.
