Commission Minutes III regular meeting of the Zoning and Planning Commission was held on
Tuesday, June 29, 1993 at 6:30 p.m. in the Council Chambers of Hopkins
City Hall.
Present were Commission members Hutchison, Winship, Racek, and Day.
Also present was staff member Nancy Anderson, City Attorney Jerre
Miller, and Council Representative Redepenning.
Absent were Commission members Gullickson, Johnson and Reuter.
CALL TO ORDER
The meeting was called to order at 6:30 by Chairman John Hutchison. 1
APPROVAL OF MINUTES
Mr. Winship moved and Mr. Racek seconded the motion to approve the
minutes of the May 25, 1993 meeting. The motion carried unanimously.
ITEM:
SUBD 93 -1 PRELIMINARY /FINAL PLAT WESTBROOKE HILL
Public hearing to consider a preliminary /final plat of Outlot C, south
of 1144 Seventh Street South.
The ublic hearing was opened at 6:40. Staff reviewed the proposed

plat with the Commission. Todd Jones appeared before the Commission
on behalf of Three S Properties.
There was little discussion on this item. No public comments were
made. The public hearing was closed at 6:45.
Mr. Winship moved and Mr. Day seconded the motion to approve
Resolution RZ93 -12 recommending approval of a preliminary /final plat
for Westbrooke Hill.
The motion passed unanimously.
ZN93 4 REZONING
Public hearing to consider rezoning of Outlot C south of 1144 Seventh
Street South from B -3 to I -1 and R -2.
The public hearing was opened at 6:40. Staff reviewed the rezoning of
Outlot C with the Planning Commission. The north half would be
rezoned to Industrial and the south half residential. The rezoning
will allow the mini storage to expand and the patio homes to construct
a maintenance building.
III There was little discussion on this item. No public comments were
made. The public hearing was closed at 6:45.

Mr. Racek moved and Mr. Winship seconded the motion to approve
Resolution RZ93 -13 recommending approval of a rezoning for the
Westbrooke Hill plat.
The motion passed unanimously.
CUP93 5 CONDITIONAL USE PERMIT MINI STORAGE
Public hearing to consider amending the conditional use permit for
Fortress Mini Storage to allow construction of an addition to the
south side of the site.
Staff reviewed the proposed addition with the Commission. Todd Jones
representing Three S Properties appeared before the Commission.
There was little discussion on this matter. No public comments were
made. The public hearing was closed at 6:45.
Mr. Day moved and Mr. Racek seconded the motion to approve Resolution
RZ93 -14 recommending approval to amend the conditional use permit for
Fortress Mini Storage.

1 VN93 4 VARIANCE 102 EAST WAYSIDE ROAD
Consideration of a 14 foot rear yard variance to construct an addition
at 102 East Wayside Road.
As the applicant was not present, Mr. Day moved and Mr. Winship
seconded the motion to move this item to the end of the meeting.
The motion passed unanimously.
ZN93 5 ZONING ORDINANCE AMENDMENT CONDITIONAL USE PERMIT
Public hearing to consider an amendment to the Zoning Ordinance
regarding conditional use permits.
Staff reviewed the proposed changes with the Planning Commission. The
Planning Commission had reviewed the proposed changes at the previous
meeting. There was little discussion.
The public hearing was opened at 6:48. No one appeared in regards to
the issue. The public hearing was closed at 6:49.
Mr. Day moved and Mr. Racek seconded a motion to approve Resolution
RZ93 -16 recommending approval of Ordinance 93 -27 amending section 525
111 of the Zoning Ordinance.

ZN93 -2 ZONING ORDINANCE AMENDMENT RELIGIOUS INSTITUTIONS
Public hearing to consider amending the Zoning Ordinance to prohibit
churches in the B -2 and B -3 zoning districts.
Staff reviewed the proposed changes with the Commission. Staff also
reviewed what had taken place in the City of Hastings in regards to a
similar issue. The City Attorney strongly recommended a study be done
to enable the City to have something on which to base their decision.
Staff stated they had contacted several consultants asking them to do
a study, but could not find a consultant who was interested in doing
this type of study.
The public hearing was opened at 7:10. No one appeared in regards to
the issue. The public hearing was closed at 7:11.
The Commission recommended that staff check to see if a study had been
done on churches in downtown areas and to prepare a conditional use
permit.
Mr. Day moved and Mr. Racek seconded the motion to continue this item
to the July meeting.
The motion passed unanimously.

VN93 -4 VARIANCE 102 EAST WAYSIDE ROAD
Staff reviewed the applicant's request with the Commission. Robert
Schmidt, the applicant, appeared before the Commission. Mr. Schmidt
proposed to change the design of the addition to a flat roof, thus
giving the addition the look of a courtyard. There was considerable
discussion on the merits of the variance.
The City Attorney offered the observation that the applicant's
property is a corner lot, the configuration and size of the house, and
the way the home was originally constructed without a basement, the
applicant cannot put his property to a reasonable use without a
variance.
Mr. Winship moved and Mr. Racek seconded the motion to grant the
variance with the revised plan.
The motion passed unanimously.
DISCUSSION OF MULTI FAMILY SITES
III The Commission discussed the taxes and the crime rate related to multi
family buildings. No action was taken.

Mr. Racek moved and Mr. Winship seconded the motion to adjourn the
meeting at 7:50 p.m. The meeting adjourned by unanimous consent.
