Commission Minutes A regular meeting of the Zoning and Planning Commission was held
on Tuesday, September 28, 1993 at 6:30 p.m. in the Council
Chambers of Hopkins City Hall.
Present were Commission members Reuter, Hutchison, Winship,
Racek, Day, and Gullickson.
Also present were staff members Nancy Anderson, City Attorney
Jerre Miller, and Council Representative Anderson.
Absent was Commission member Johnson.
CALL TO ORDER
The meeting was called to order at 6:30 by Chairperson Reuter.
APPROVAL OF MINUTES
Mr. Day moved and Mr. Winship seconded the motion to approve the
minutes of the August 31, 1993 meeting. The motion carried
unanimously.
ITEM:
III REVIEW CLIFF LAMBERT'S CONDITIONAL USE PERMIT
Staff reviewed the item with the Commission. Applicant Carla
Lambert and applicant's attorney, Frank Rondoni appeared. Cliff
Lambert has applied for a building permit for his property. He
is proposing to build a small office building with underground
storage facility. The original plan had also allowed for vehicle
storage in the building. There was little discussion.
Mr. Winship moved and Mr. Day seconded a motion to approve the
plan for a smaller building with the stipulation that it meets
the Zoning Ordinance requirements and gets Watershed District
approval.
Motion passed unanimously.
ITEM:
CUP93 -7 CONDITIONAL USE PERMIT BIG WHEEL ROSSI
Public hearing to consider an application by Richard Shaller to
construct a 10 bay auto repair center at 302 Blake Road.
Staff stated that Mr. Shaller requested to have this item
continued to the October meeting as the noise study requested by
the Commission at the August meeting has not been completed.
4111 The public hearing was opened at 6:46. No one appeared in
regards to this issue. The public hearing was closed at 6:47.

Mr. Racek moved and Mr. Winship seconded the motion to continue
this item to the October meeting. The motion carried
unanimously.
ITEM:
CUP93 -8 CONDITIONAL USE PERMIT RENTAL SERVICE
Public hearing to consider an application by J.D. Lindstrom for a
conditional use permit to operate a rental service at 404
Mainstreet.
Staff recommended this item be continued to the October meeting
as the applicant has not submitted any plans to date.
The public hearing was opened at 6:46. No one appeared in
regards to this issue. The public hearing was closed at 6:47.
Mr. Day moved and Mr. Winship seconded the motion to continue
this item to the October meeting. The motion carried
unanimously.
ITEM:
VN93 -5 SIGN VARIANCE NOW SPORTS
Variance request to consider a larger sign than allowed at
426/430 Mainstreet.
Mr. Gullickson joined the Commission at this time.
Staff reviewed the item with the Commission. Now Sports recently
had a 10' x 15' foot sign painted on the side of their building.
This sign exceeds the maximum size allowed by Ordinance in this
district. Also, applicant's sign painter did not secure a permit
for the sign.
The applicant has now made application for a sign permit. He is
also requesting approval of a variance to allow the subject sign
to remain.
Robert Sumada and Paul Himmelman, representing Now Sports,
appeared before the Commission. They explained there had been a
sign painted on the west side of the building for a number of
years. This sign was removed and there had been no sign for
about a year. They stated the new sign in question is the same
size as the original.
There was discussion regarding whether the sign was grandfathered
because of the previous larger sign. Staff informed the
Commission that when a sign is removed, any new sign which is put
up would have to conform to the existing sign ordinance. If the
original sign was retained it could have been maintained and
would be grandfathered under the ordinance. The staff noted that

other signs painted on walls, when repainted, have received
permits and conformed with the existing ordinance.
Mr. Winship moved and Mr. Racek seconded the motion to approve
Resolution RZ93 -19 denying the sign variance at 426/430
Mainstreet. The motion was approved on a 5 -1 vote, Mr. Hutchison
voting nay.
ITEM:
CR93 -1 CONCEPT REVIEW LOT DIVISION
Concept review to consider dividing the lot at 7 Webster Place.
Staff presented an overview of this item. Applicant is proposing
to divide a 89,851 square foot lot into two lots. Access to Lot
A would be by easement across Lot B. Staff is opposed to the
unusual lot configuration and the lack of access to Lot A. This
position was supported by the City Attorney.
Mr. Hayes, the applicant appeared and asked for input from
Commission members as to their feelings about the proposal.
Several people from the Belgrove neighborhood appeared and voiced
their opposition to the proposed lot split. Jerry Lavin of 14
Loring Road gave a brief history of Belgrove. Residents Dr.
Lawson, Don Blumberg, and Mark Kammerer stated their opposition
to the proposal. They felt it would violate the character of the
neighborhood and would be precedent setting.
Commission members supported the position of staff and legal
counsel and were sensitive to the negative feelings from the
neighbors. They felt the proposed division of the lot was a poor
design and didn't fit the neighborhood.
Chairperson Reuter thanked the applicant and stated that the
neighbors had spoken and were heard. It is the duty of the
Commission to uphold the Ordinances as written. Ms. Reuter
suggested Mr. Hayes meet with staff to work out the differences.
Item: REVIEW ORDINANCE STANDARDS
Discussion from the joint meeting with City Council /Zoning and
Planning Commission two weeks ago resulted in staff recommending
random sampling of lot sizes and set backs.
Mr. Gullickson moved and Mr. Winship seconded a motion to adjourn
the meeting at 8:45 p.m. The meeting adjourned by unanimous
consent.
