Commission Minutes III ZONING AND PLANNING COMMISSION MINUTES August 25, 1998 A regular meeting of the Zoning and Planning Commission was held on Tuesday, August 25, 1998, at 6:30 p.m. in the Council Chambers of Hopkins City Hall. Present were Commission members Sid Blair, Randy Engel, Dorothy Boen, Pat Gleeson, Roger Gross, Maura Swanson, and Council Representative Fran Hesch. Also present were City Planner Nancy Anderson and City Attorney Jerre Miller. CALL TO ORDER Mr. Engel called the meeting to order at 6:30 p.m. Mr. Engel welcomed Maura Swanson to the Commission. APPROVAL OF MINUTES Ms. Boen moved and Mr. Blair seconded a motion to approve the minutes of the July 28, 1998, regular meeting. The motion carried unanimously. CASE NO. CUP98 -7 CONDITIONAL USE PERMIT STIELEIBAKKEN Ms. Anderson stated that this item is to be continued to the September meeting. Mr. Gross moved and Mr. Gleeson seconded a motion to continue CUP98 -7 to the September meeting. The motion was approved unanimously. CASE NO. VN98 -5 VARIANCE ACCESSORY BUILDING Ms. Anderson reviewed the variance with the Commission. Christopher Rohr, the applicant, appeared before the Commission. Mr. Rohr stated that there was a permit for the foundation work but the second contractor did not get a permit for the garage. He also stated that he wanted to match the pitch of the roof of the house and that is why the garage is higher. Mr. Gleeson moved and Mr. Gross seconded a motion to approve Resolution RZ98 -19, approving a variance to the existing accessory building at 314 10 Avenue North and directing staff and the City Attorney to draft findings of fact for the Commission to review at the September meeting. The motion was approved on a 4 -2, vote. Mr. Blair and Mr. Engel voting nay. CASE NO. VN9S -4 VARIANCE SIDE -YARD SETBACK Ms. Anderson reviewed the applicant's request with the Commission. Roger Jewett, the applicant, appeared before the Commission. Mr. Jewett stated that his lot had an unusual shape, he also stated that when the home was constructed 45 years ago, the side -yard setback was five feet. Richard Barkman, of 345 Herman Terrace, appeared before the Commission. Mr. Barkman is Mr. Jewett's MINUTES OF THE ZONING AND PLANNING MEETING 0 Page 2 neighbor and has no objection to the addition. Mr, Jewett also stated that by building the bathroom they could stay in their home longer and provide a better life style. The Commission discussed other alternatives for moving the bathroom or moving the lot line. Mr. Blair moved and Ms. Boen seconded a motion to approve Resolution RZ98 -18, denying a variance to construct an addition at 341 Herman Terrace. The motion was approved on a 5 vote; Mr. Gleeson abstained. ADJOURN Mr. Blair moved and Mr. Gleeson seconded a motion to adjourn at 8:25 p.m. The motion was approved unanimously.
