SECOND READING AMENDING SECTIONS 605 AND 710
OF THE HOPKINS CITY CODE REGARDING
MUNICIPAL WASTE COLLECTION
Proposed Action
Staff recommends that the Council approve the following motion: Move that the Hopkins City Council
approve Ordinance 2010 -1011 amending Sections 605 and 710 of the Cites
Adoption of this motion amends Sections 605 and 710 of the Hopkins City Code to clarify requirements and
remove outdated language.
Overview
Section 605 of the City Code deals with Solid Waste Management. The City provides refuse service in the
"City Service Area" to all single family dwellings, duplexes, double bungalows and triplexes. Each dwelling
unit is required to have its own authorized waste receptacle. "The owner or occupant of any residential
dwelling(s), ... and any other person having refuse as herein defined shall keep on such premises sufficient
authorized waste receptacles for storage of refuse accumulating on the premises between disposal and
collection." Even with this language, the utility clerk receives the occassional argument that a duplex or
triplex only needs one waste receptacle. The clerk is requesting that the following language be added to
Section 605.02 to clarify that each dwelling unit needs its own receptacle: 'Bach dwelling unit is required to
have one (1) sufficient size Authorized Waste Receptacle."
Section 710.07, Subd. 9 refers to Outside Remotes for water meters. Since switching to radio read, the City
no longer uses outside remotes.

ORDINANCE NO. 2010 -1011
AN ORDINANCE AMENDING
SECTIONS 605 AND 710 OF THE HOPKINS CITY CODE
THE COUNCIL OF THE CITY OF HOPKINS HEREBY ORDAINS AS FOLLOWS:
SECTION 1. That Section 605.02 is amended as follows:
605.02 Mixed Municipal Solid Waste Collection and Disposal
Services. Subdivision 1. City Authority. The City shall
have the authority to require that all owner(s) or
occupants(s) of any properties; including residential
dwelling(s), multiple- family dwelling(s), commercial
building(s) and institutional building(s), provide or
contract to provide services for the collection and disposal
of mixed municipal solid waste which accumulates on said
property as required by state statute and in accordance with
the specific methods defined and hereinafter set forth as
follows:
a) City Service Area. The City shall have the exclusive
authority to provide or contract to provide services for the
collection and disposal of all mixed municipal solid waste
and to provide a separate collection for recyclable materials
within the City Service Area. Charges for such services are
established by Council resolution. It is mandatory that all
properties within the City Service Area, have basic service,
and be charged accordingly per Section 605.04. Each dwelling
unit is required to have one (1) sufficient size Authorized
Waste Receptacle.
SECTION 2. That Section 710.17 is amended by deleting
Subdivision 9:
Section 3. The effective date of this ordinance shall be the
date of publication.
