Height Variance/SuperValu G1TY OF r H OPKIN S April 7, 2005 Planning Report VNO5 -2 HEIGHT VARIANCE SUPERVALU Proposed Action Staff recommends the 'following: motion: Move to adopt Resolution RZ05 -10, recommending denial of a height variance for the east addition to Supervalu's site at 300 Second Avenue South. Overview Supervalu is proposing to construct a 130,000- square -foot addition to the existing building at 300 Second. Avenue South. The proposed addition will be located on the east side of the existing building. The existing parking on the east side of the building will be relocated to the south side The industrial district maximum height for a building is 45 feet. The existing building was granted a height variance. The building at its highest point is 47.5 feet. The applicant has also applied for a front yard setback variance. i Primary Issues to Consider What does the ordinance require? What are the specifics of the applicant's request? VNO5 -2 Page 2 Primary Issues to Consider. What does the ordinance require? The height for an industrial building abutting a residential district is 35 feet. What are the specifics of the applicant's request? The applicant is requesting a height variance of 12.5 feet. The addition at its highest point will be 47' 6 What is the staff's recommendation? In this case, the applicant's same hardships exist for the height variance for the south addition, as for the east addition. Staff feels that a height variance can be supported, but the Planning Commission denied the height variance for the south addition. Because staff feels that the addition to the east will have more of an impact to the neighborhood, staff is not recommending approval of the site plan. A height variance can be supported if the site plan for the east is approved. Alternatives. 1. Recommend approval of the variance. By recommending approval of the variance, the City Council will consider a recommendation of approval. If the Planning Commission considers this alternative, findings of fact will have to be stated that support this recommendation. 2. Recommend denial of the variance. By recommending denial of the variance, the City Council will consider a recommendation of denial. 3. Continue for further information. If the Planning Commission indicates that further information is needed, the item should be continued. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: RZ05 -10 RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING DENIAL OF A VARIANCE FOR HEIGHT WHEREAS, an application for Variance VN05 -2 has been made by Supervalu; and WHEREAS, the procedural history of the application is as follows: 1. That an application for Variance VN05 -2 was made by Supervalu on March 25, 2005; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed notice, held a meeting on the application and reviewed such application on March 25, 2005: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of the City staff were considered; and 4. Legal description of the parcel is as follows: Lot 1, Block 1, Supervalu Addition NOW, THEREFORE, BE IT RESOLVED that application for Variance VN05 -2 is hereby recommended for denial based on the following Findings of Fact: 1. That the Planning Commission found no hardship was demonstrated for the height variance for the south expansion and the same conditions exist with the addition to the east.
